One of my minor dependents appears to have been out of status due to non renewal of their H4 visa. We thought that like the original application, dependents were covered by my renewal, found out too late that this is incorrect. Since then we have obtained renewals and the dependent in question now has an approved H-4 status, plus pending 485 and advanced parole.
I have been told though that time out of status is not counted against minors. Is this true?
Is there any risk in travelling out of the country to get visa stamped and returning? I understand this resets the clock. Can the embassy look into the history, find out that previous issue and deny the H-4 stamping because of it?
I am very discouraged by this long drawn out process. Any information would be appreciated.

Hi,
Can a H4 visa holder apply for the Praxis test series and then apply for State Teacher Certification. I know on H4 we can't work but is it possible , just getting the Teacher Certification.
If it's not possible on H4 then I have an option to convert H4 to L2 (as my husband will change his status from H1 to L1) and get EAD.Can after that can I get the Teacher Certification from PA ?
I checked on PA State Teacher Certification requirement for Foreign Educated Teachers and there is one point like this.
- is a citizen of the United States or holds an resident alien (green card) visa
Will EAD/H4 considered as Resident Alien Visa ?
Or without Green Card it's not possible to get this Certificate ?
Please help me.

Is there any risk in rescheduling a fingerprinting appt? I am travelling when the appointment is currently scheduled for:(. Does that impact the overall processing times of 485/EAD/AP?
With an travel plans that you can attach asking for a later date for the FP. If possible give them the possible dates you will be arriving back and request a date after that. Make sure in your absense somebody is available to pick up your FP notice from the mailbox. Send your request as early as possible with a delivery confirmation and/or signature requried so you have a track of whether your letter made it to them in time just in case..

Nov.2002 - RIR Labor filed in CA
June 2006 - Labor approved from Phily BEC
July 2006 - I-485 , I-140 filed at TSC
Sept.2006 - I-140 approved
Got stuck in namecheck ( name check may be still pending )

We recently assisted a client from Johannesburg, South Africa, regarding an H-1B specialty occupation visa. He was approved for an H-1B visa, but in order for our client to enter the United States, he must obtain an H-1B visa in his passport. Because the chances of visa issuance vary greatly depending on documentation and individual circumstances, we suggested that he go to the interview at the U.S. consulate very well prepared. We told him to take a certified copy of his entire H-1B package that was filed with the Immigration Service, along with his Form I-797 Approval Notice. We also suggested that he take original birth certificates, marriage certificate, and proof of financial support. He attended the interview this morning and his experience at the U.S. consulate in Johannesburg, South Africa was documented as follows.
“My wife, myself and our son had our interview at the U.S. Consulate here in Johannesburg this morning, at 9:00am. We duly arrived at 8:30am, had our relevant DS documents checked at the door, took a number, and waited for the “call.” At promptly 9:00am we were called to a booth, where our fingerprints were taken, the DS forms checked with the original I-797 form, and then told to go and sit down again. 10 minutes later, we went back to the booth, had our fingerprints taken again, and that was it. I have I129 document (Petition for Nonimmigrant worker) which was valid from 10/01/07 to 09/24/2010. However i never used it. As My husband is working in US on H1b visa, i am now looking for job in US. Can you please let me know if this I129 can be used or not. I would highly appreciate early response.

AFAIK those who filed after July 30, 2007 filed with the new fee, and do not have to pay the fee for the EAD. However you can't e-file, but have to send in your paper application form.

The sad part about the Brokow's report is that he focused on H1B issue and not the real problem which is the green card issue.
Yes, people come on H1B - however, for those immigrants to put down the roots, it has to happen through green cards and not H1B extensions (neither one of which was mentioned in the report). I am not sure if this is a two part series, but it should be.
IV members should write to MSNBC Nightly News to do a more in depth story on immigration problems of the high skilled immigrants.

I have a green card and I'm thinking about living 50/50 in US and my home country Slovakia.
I've had GC for about 6 years and been living quite a travelling life spending more time outside US then in. Its also about 50/50 with trips always around 10mo in or out.My continuous residency is broken.
Do you think that if i live 50/50 in and out for five years they will give me citizenship with such history?
Got GC after Mom.

If you spend more than 180 days a year in the U.S (total of 2.5 years in the 5 years preceding to the application) and show ties to the U.S (a house, tax returns, family etc). If so, it should not be a problem. The U.S ties come into picture only when you are out of the U.S for a extended period of time (like in your current case). Good luck.

I guess we should ask them to remove the employer's restriction, which is the prime reason for extreme exploitation. H1b should not be restricitive. IV should also address the same. We are looking at the current problem with retrogression only, but what about future aspirants who come on H1.

The reflection in the wet sand is good & colors are nice, but I agree with Don that there is too much sky for the scale of the figure. I had to look for the silhouette, because the clouds drew my eye to the left of center. A little saturation work would probably make the colors even more appealing. Just my opinion, your mileage may vary. ;)
