Even if it is after I-485 1 year pending, I should get it for 2 years, because my I-485 filing date is July 2nd!

Also if you can set aside some money for >3 years, putting it in an NRO term deposit is also pretty good. Now they range around 7.5 to 8%. You can repatriate the interest income after due taxes are paid.

I graduated in MS (I'm on H4 currently) recently.My previous degree is from India (passed out BCOM in 1999). I dont have any IT experience.

I concurrently filed both my I-140 and I-485 back in Oct 09. My I-140 was approved on March 18th and then nothing since. I read that by concurrent filing the process is quicker. I am on an EB1-C. My question is has anyone had any experience in the time frame for concurrent filing under the category i am under? I have checked the tracker and cannot see anyone in similar position. Time line is what i am looking for or is it a "wait and see" situation?

Hello can anyone tell me the procedure to file I-539. I overlooked my wife's H4 visa (assumed visa will be renewed when i get my H1 renewed at consulate). I am looking for information to file for I-539
Also My wife's visa expires on Dec 9th 2007 (I94 expires on Dec 20th 2007). Is it possible for my wife to stay beyond Dec 20th if i dont receive the H4 renewal by that date. I am planning to file I-539 by Nov 8th 2007

If you need any kind of corrections to your I-94, please visit your local CBP office. Website is www.cbp.gov. On this website search for Deferred Inspection locations and visit the nearest one.
CBP officer will give you new I-94 with the corrected name, I-94 validity date, DOB, class of admission etc...

I didnt mean to burst your bubble...but may be its just that you are getting another finger printing notice. Its expires in 15 months. If you read the other forums July 07 filers have started getting their next set of FP notices. I wouldnt get too carried away.

I am a software consultant on H1B. I have recently concluded my employment in California for client A and now I have relocated to GA where I am working for client B.
I have the following questions in this regard:
1) Should I do an LCA transfer to the state of GA from CA? + How many days do I have from the date of original relocation to do this transfer?
2) Can I do this paper work by myself or would I need the help of an immigration lawyer? + Any idea of what the average / approximate expense would be?
Any information with regards to this is highly appreciated.

Your Company has to file LCA not you. Technically they have to file H1B amendment. Many people does not this. It has to be filed Immediately. There is nothing like grace period.

Reminded me of an incident when I was a teenager, a budding cricketer and was a huge fan of Nike sports shoes. I would see these uncles with big paunches wearing Nike and would think that the world is unfair that people like me don't get to wear Nike while random uncles do. Completely random thought!!!!
The point being - the situation we are in, we hope that our plight should be a discussion point in every conversation that India and US ensue in. It crossed my mind a couple of times that we should have pushed for it. State of mind I guess.

Big goof up on AP document, my spouses document had my alien number. Thankfully, they recognized it as a USCIS mistake and let her in. She had to wait 3 hours for processing, they also took both AP forms and set up and appointment at USCIS office in SF.
I have to go to SF tomorrow. Couple of qns that some one may be able to answer
1) What should i expect tomorrow?
2) When im there can i ask them any question regarding the status of my case?
On a separate note, i heard from a friend that AP is getting approved in 15 days now. Is that a one off case?

Hunton Immigration and Nationality Law Blog Has Just Posted the Following:
On July 1, 2010, the Vital Statistics Office of the Commonwealth of Puerto Rico began issuing new, more secure Puerto Rican birth certificates to US Citizens born in Puerto Rico. As of October 1, 2010, all certified copies of Puerto Rican birth certificates issued prior to July 1, 2010, will no longer be valid. Accordingly, the Citizenship and Immigration Services (USCIS) issued a press release providing guidance to US employers with regard to the I-9 process. For new employees, employers may continue to accept all Puerto Rican birth certificates through September 30, 2010; after that date, only the new Puerto Rican birth certificates (issued on or after July 1, 2010) we be acceptable for I-9 purposes. Therefore, as of October 1, 2010, employers must pay close attention to the issuance date of Puerto Rican birth certificates presented for I-9 purposes.
For existing employees, there is no need to re-verify the employment authorization of employees who previously presented pre-July 1, 2010, Puerto Rican birth certificates. Federal Contractors subject to the Federal Acquisition Regulation E-Verify clause may continue to accept all Puerto Rican birth certificates prior to October 1, 2010, but beginning on that date, only the new Puerto Rican birth certificates issued on or after July 1, 2010, will be acceptable. Federal Contractors may not ask for the newer version during I-9 reverification of those individuals who previously presented the older version of the Puerto Rican birth certificates.

As far as I know, the 5 year wait period was until a couple years ago when the family based GC was backlogged. I got married in 2004 and had to wait until 2008 to file for GC, when my husband got his citizenship. At that time, our attorney advised this as the best course, since the priority dates were about 5 years out.
Filing for spouse falls under 2A of the family sponsored GC and currently the priority date for 2A India is 01 Jan 2010. In my estimation, you should get a GC within 12-18 mths.
But then again, I am not an attorney - so please consult one to validate this information.

ME:said MCA
then He di't ask me any anthing and issued 221g while slip.asked to come along with all the docs marked in slip.
docs included..
1 LCA
2 form I 129 cover letter of USICS
3 Projoject detail
4 unemplyment wages reprt
5 A Letter (on Letter head) from the personnel dept at US job site stating that there is vacancy for u.
again i went on 14 jan 2010 had submitted all the docs
except that letter mentioned above point 5. actually my petitioner had told me that u do not need clinet letter as u have to wok on inhouse project.
and issued 221g yellow
saying once the administrative process will be completed will notify u bya mail"
on jan 25 got mail stating administrative processing has been completd .
u need to come to consular anytime 9:30 am with the pending letter ,passport and doc pertaing with ur application.
Can u pls help me out? what will be the format of this letter and from where my petitiner will be able to get it.
