Employer can withdraw I-140 even after 180 days. If possible, avoid that scenario. It will cause RFE or, worse, NOID. But ultimately you'll prevail.
how do I avoid that scenario?
If I send some information to USCIS that I am invoking AC 21, they would not allow my employer to revoke I 140?

I have nothing to say about the dems in particular...........however, you are being extremely short sighted if you want Obama to loose. He is driving this country in the right direction, and you go with any republican who just talks nonsense of tax cut and national security, you may have a green card or even citizenship - and your children will be wishing to go to another country as there are no opportunities here!

i disagree with you, i love obama the candidate, but since then he did little to merit his election, so howz health care gonna help ppl who have no job in the first place, stimulus was a colossal failure by any standard, he referred republicans as "enemies", howz that for a "change" in dc? we all know this country needs innovation but therz no significant increase in R&D under his presidency, i love some of his decisions but saying he is taking country in the right direction and there is no republican who can do that is not true,
he is too left, we need a leader who does not lean left or right

I485 submitted in NSC 2nd July. Receipt date 9th Aug.
Working for same employer for last 5 years.
Had lud updates twice in last 5 days. (Also recently did a A11 online (address change for me and my family).

Hello Friends,
As you might have guessed, I am on the EB3 bandwagon because of circumstances that were beyond my control [The filing attorney screwed up :( ]
At the time of my EB3 filing (Feb. 2004) I did possess a Masters degree and more than 5 years of Work Experience and the job responsibility that my petition was filed for, did require a Senior worker with Masters experience. Unfortunately, things didn't go that way and here I am.
I keep reading about some lucky souls [god bless their souls :) ] who have managed to retain their priority dates and converted to EB2.
I really want to do that. I am not sure where to start.
1. I used AC21 and took up a new job recently. Do I approach my new employer and talk to them to see whether they would be able to file my petition in EB2 category? The bad thing is, when I joined them, I told them I don't need any sponsorship or assistance from them. It would be a volte face to go back to them and request them to do something. And the best part is, there is no guarantee that my company would file my petition.
2. Do I look for a new employment and if and when I clear the selection process, do I tell them that the only way I could join them is if they could file my EB2 petition? If they think that my services is a necessity, they might do it else they might look for other candidates. It s like throwing a dice.
3. Do I look around for desi consulting companies that would file my EB2 and in return I work for them (using my EAD) through the EB2 petition/adjudication process. With this approach, the desi companies might do it, but like other people, I also think the reputation of these desi consulting companies is severely dented and there is all the more chance that the EB2 petition might get denied.
Gurus...any help or advise or information is really appreciated.

I cannot believe that out of the thousands who are affected, only 155 so far have taken a step to scream for help by writing this letter. Guys, C'mon, we can do better than that.

The issue gets dumped in the back burner and may or may not get resolved. On the other hand, if all of a sudden, several 100 users start complaining about an issue, we roll up our sleeves and start working on a fix right away. I should say, this applies not just to IT, but every other area. Unless, you make them aware of the problem, there is going to be NO resolution.

Thanks Ebizash. Yes I too have soft lud's on my wife AP on 9/25 and 9/28. I sent it to NSC. Yes the same barcode scanning reason was told to me by USPS. I hope that USCIS recieved the documents.

OK looks like I was wrong. Some July Visa bulletin people may not be able to buy houses.

My company paid for attorney fees. I don�t know the amount for that. My wild guess would be 4000$
My pocket expense
$680 - medical tests
$75 - photographs
$50 - mailing fees.
$100 � Extra Day care expenses. My wife and I have wasted 2 working days for this filling, We had to work extra hours and week ends to compensate. Had to drop my kid at the day care extra hours when we were working extra hours.

Dont mean to flame you, but you say that you are not a crab and the next moment you bring up religion, faith, Indian etc and associate that to IV's
goal.
Whats wrong in that are they not the guiding principles of living life. when we all get angry about not getting the GC, this same faith and values keep us sane. I associate these with IV so that God can give them strength to succed. we will give our donations to support that.

What reason did you give for declining this promotion? what kind of company is this ? how big ? would your salary increase ?
Maybe if you answer this, I could think of something..but as of now..if its a good company and you like it..explain to them the nitty gritties about how change in occupation, classification, salary etc would jeopardize your GC process...i can give more suggestions if you want to send me a PM..

Receipts: 7/18.
No Finger printing notice received. This was at NSC. Mostly will get 2 years EAD as my PD is nowhere near to current but will update everyone for sure once I receive the cards!

Arent you concerned that if its approved on Oct 1, and you didnt get it, then where is it? Did you ask them as to why you havent gotten it in mail even though it has been approved a month ago? Also, did you check with your lawyer if he got anything?
It was approved on 10/1*/2007 not exactly on 10/1/2007. I was concerned and I asked her. What she told me is that once case is approved it generally takes around one week to get that mail out from mailroom and once it is out of mail room then generally it takes 2 weeks to get the mail for you. So calculating that I thought I should get that within a day or two. ANd another thing she told me is that once mail is out from USCIS mailroom then USCIS does not have any control or tracking mechanism so I do not have any choice other than waiting for mail...And yes I have just shooted an email to my lawyer. What do you advise?

I have heard from one of the forums here that an estimated 500K people will file this month since all PDs are current. EB-3 mexico + phillipines togther alone will be close to 300K. God help the Job market.
Also minimum wait time will be 500K/140K ~ 4 yrs before they get to process your GC. Add to that the time for namecheck backlog 2+ yrs. So total 6+ yrs before getting GC........

guys i posted flyers in areas around LA at Artesia, Temples/Grocery stores around Orange County. Will do more of posting around LA. If you know of places around LA where there can be more of Indians, Chinese, Filipinos please let me know I will post them and try to talk to people around.

Does this (given below) means DOL has the authority to find something and send Notice of Intenet to Revoke at any point of time during the GC process?
"The DOL Perm rule, at 20 CFR 656.32 provides for the revocation of approved labor certifications by DOL if a subsequent finding is made that the certification was not justified. In such instances, DOL provides notice to the employer in the form of a Notice of Intent to Revoke an approved labor certification that contains a detailed statement of the grounds for the revocation and the time period allowed for the employer's rebuttal. The employer may submit evidence in rebuttal within 30 days of receipt of the notice. If rebuttal evidence is not filed by the employer, the Notice of Intent to Revoke becomes the final decision of the Secretary. If the employer files rebuttal evidence and DOL determines the certification should nonetheless be revoked, the employer may file an appeal under 20 CFR 656.26 within 30 days of the date of the adverse determination. If the labor certification is revoked, DOL will also send a copy of the notification to USCIS and the Department of State."
