Hi,
My company has started process of applying for my Green card in EB2 category. However, attorney has some issues with that.
I joined my company on a post completion OPT based on completion of course work in January 09. At that time I was MS thesis student and had to just defend my thesis. However later in Feb, because of some differences with my adviser, I converted to MS Non thesis and graduated in May 2009 with the course work that I had completed in Dec 08. In all respects, I had completed all coursework requirements for my degree prior to Dec 2008. My company's attorney recently told me that this may be a problem for an EB2 case as I joined company before I graduated with MS.
I have all documents available with me that all course work for the degree was completed before I joined the company.
I am bit worried. Can some one advise me on this? I will be grateful.

I'm in kind of a tricky situation.
I currently work for a consulting company who is sponsoring my GC.Our client has offered me a full time position and I was planning to use AC21 to switch over but better sense prevailed over me to continue with my current employer to avoid any issues in GC processing.Now my client is not willing to extend my contract.Given the current job market, I think it might take atleast a month or two for my employer to find me another project.
Just in case my I485 gets approved, can anyone please let me know if it is ok to be without pay (employer will not pay between projects) after the GC gets approved?Please advise.

I sent her an email today to ask her to mail the originals and she refused.
"We usually keep the original receipts. " was her answer.
What to do? This is so frustrating. ARGHH!!!!
I know I have the right to ask for them but I want to keep it civil and not antagonize her. Is there any reason I can give her, like travel, to make her send me the originals without getting into a fight?

given the priority date and the processing dates i want to understand how the uscis will process our applications
now the Nebraska service center is processing June 8, 2008. so based on the priority date it is processing all the applications that are current and have been filed before June 8th. Now let us say they take an application and start processing it and suddenly the PD goes back and I am not current any more - what do USCIS do. Do they just stack it back or what do they do. any thoughts.

I am wondering what conclusion (if any) can be drawn from LUD? On USCIS website my I-140 case shows LUD to be 05/09/2007 and hence was wondering what does it mean ? When I click on my case on the online case status website (of USCIS) still provides old data only and does not reflect the status for LUD...

But just make sure your parents carry a document that has details about your name, ssn, address, job, etc.
In case the office asks where they are going to stay, etc. They might know all this, but will be helpful to have on paper too.
Other than that, nothing is required, just their passports and visas.
Dont forget to get medical insurance. Ofcourse its not mandatory.

Kudos to Senator Chuck Schumer for raising the profile of a serious issue - discrimination against same-sex partners in US immigration law. Since EB-1 does not need labor certification, the process is completely independent of EB-2. As such you cannot "port" your EB-2 application the way people transition from EB-3 to EB-2. You will have to apply directly to USCIS with evidence of your "extraordinary ability" in your field, such as honorable membership of professional bodies, research track record, letters from well-known people in your field etc. The first stepto convince USCIS about exceptional ability is very involved, but there on I-140 and I-485 should proceed far more smoothly than EB-2.
