Congress never thought that I-485 processing would take more than 1 year (I-485 pending for 180 days is called "long-delayed" in 8 USC 1154(j), see also 8 USC 1571). If the USCIS was able to process all I-485 in one year time frame, there would be no retrogression!

I left my previous employer more than 6 months back , he didnt paid me my final paycheck and i complained to DOL since 3 months...now wehn i asked for my W2 he said me to do whatever i feel and he is adamant at not giving it....moreover he said that his company has suffered losses worth 25K and his lawyer has sent a legal notice in this regard....and when i said how will we file taxes he says he wished for me to be out of status and go back.....
Since i have complained to DOL and also it is more than 6 moths since i left his organisation giving proper notice and have email confirmations, can he issue me legeal notice.....?please advice...
He is also saying that he has written to USCIS that I am fraud,....though I have been working in fortune 100 companies and now also working in reputed company and never lied for anything and was on project from day 1 since I came to States....? can USCIS cause problems for me in future...
Also, he seems to have closed his company..
Folks please advice....

I have nothing against lawyers, most are hard-working and smart. But that smartness also makes them confuse others and ultimately its the clients who have to pay for the smartness of the lawyers.

My GC application is buried somewhere, had a vey bad week at work with piling up workload and closing on deadlines, my child as a cold, my neighbor's dog has an infection that shows up smelling foul in my front porch, it is going to snow and rain this weekend, May visa bulletin is released, EB-2 India has not moved up; topping all these there are some nimcompoohs here fighting out in a public forum about how incapable we all are to change the federal laws! God, have some mercy. Give some time to IV moderators and me some power to permanently ban these people to write to any immigration forums I read. At least give me my GC soon so I don't visit IV as often I do now and come across these kinds.

Howz one to live a moral and compassionate existence when one is fully aware of the blood, the horror inherent in life, when one finds darkness not only in onez culture but within oneself? I see everyone firing at each other (junior members, members, senior members, moderators and super administrators).
Here are my two cents to keep yourself calm, composed and dignified
1) Empathy will win friends and support
2) Sympathy you will have only when someone is humble and meek
3) If you lack both the society will ignore you
PS: In a fight the weak always get support, the big and strong are on their own. if they lose no one to cheer them up nor comforts.

personally i would close this thread if i did not feel it was unfair to the orginal poster.... there has been lack of civility from everyside. One rude poster, against whom there were several complaints. but even after he departed, iv bashing continued, and the pretexts are amazing. "it's an open forum" sure it is "no one should ask for contributions" really? what's an open forum? i believe the rudeness of the requests hurts our cause, but he is member like everyone else and can ask people to contribute if he wants- albeit without personal attacks which are against the forum guidelines.
btw there is a difference too between just contributing money and contributing in general. but one takes money the other takes effort and no one can apparently spare either!
there are 22,000 + members. everyone needs to understand that such a forum has all kinds of people and responses. grow up people, have a thicker skin and deal with it. no moderators or the forum has "abused" you. further it amazes me to hear that regulars who spend a ton of time on tracking threads claim to not know the organizations goals (on the front page!!) and want the core team to come explain. if the core team spent time trolling tracking threads to do that and police every piece of rude talk there would not be a forum. because...the forum only exists as part of a grassroots organization that is fighting retrogression. after the flower campaign and san jose rally, after july 17, if you are still "waiting" to be convinced, well congress is not waiting, the election cycle is not waiting and certainly retrogression is not. so maybe...if we fail...let's all wait...till 2013 as the democrat leader says...for any reform...will that be enough time to convince people living in NJ to ride up to DC and stand up for themseves?

Let us use all our networking to best use here. 10K is not a difficult number. When we started this organization, we could not even get 10 people together, but nobody gave up hope.
The success of the rally, this cause and our own greencard issues depends on each one of us. I'm sure we are all capable of sharing this responsibility.

Hi,
I sent my application on 29th Sept 2010 and have not heard anything yet.
Most of the times I can't get hold of anyone and when I do they keep saying that they are not ready yet! That's very helpful!
God forbid if I have to leave the country due to any emergency, what the heck will I do then?

I had to sent them shipping tracking info and eventually they found my application sitting in a drawer. Never bother to opened it till than. I had to go through some higher level rank person to get my case resolved. The customer rep. phone is always busy, never able to get a hold.. I don't have to visit them for next 10 years,,,, thank GOD..

My labor was filed on July 2004 and I have not received an approval yet.
I got an RFE last week stating that Employeer has to again prove the RIR status of the application.
So Lawyer has started the advertisement process again.
I am in similar situation, My PD is AUG04, EB2(Traditional), stuck at PBEC, I got an RFE saying they have only the first page of the application. My lawyer just sent all the paper work. I am currently on my 10th year on H1B. Lost my first LC to sep 11 and since then stuck with PBEC. I guess these things happen thats all. I am hopeing they will start I-140 premium process again.

not "most"!! only few have a wait of 3-4 years, most have a wait of over a decade....the numbers of applications pending at AOS stage at USCIS is scaryLook at the number of people who posted messages to this thread .... even if you say 4 times that number of people posted messages to WhiteHouse.gov it is no where close to the numbers we need .... Lets not kid ourselves - Unless there is a miracle - most of us are looking at aleast another 3-4 year wait :(

I filed on july 23rd got ead & AP but did not get FP. After reading this thread and seeing the patterns i think that if your application is processed by the center where it has to originally go then you get your FP quickly but in cases where your application went to original center and then that center sent to other centers for EAD and/or AP then their FP's is getting delayed, like my self.
I also have another problem. I changed address just after applying for I-485.I think FP is NOT dependent on PD's and or address change.
This is just my 2 cents.
