This date is for those people who try to ebcome illegal ( like us , now we are thinkign to become one). Now you cant become illegal becos of this cut off date.
:) We should find out a way to convince them we worked illegally for cash before Jan 1, 2007. Some one suggested before if we can find another H1B provide an affidavit that he/she did some lawn work at the house both of them will become eligible for the mighty 'Z' visa :D

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. UNITED STATES EDUCATED IMMIGRANTS.
(a) Aliens Not Subject to Direct Numerical Limitations- Section 201(b)(1) of the Immigration and Nationality Act (8 U.S.C. 1151(b)(1)) is amended by adding at the end the following:
`(F) Aliens who have earned a master's or higher degree from a United States institution of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (20 U.S.C. 1001(a))) in a field of science, technology, engineering, or mathematics and who have an offer of employment from a United States employer in a field related to such degree.'.
(b) Procedure for Granting Immigrant Status- Section 204(a)(1)(F) of the Immigration and Nationality Act (8 U.S.C. 1154(a)(1)(F)) is amended--
(1) by striking `or' after `203(b)(2)';
(2) by inserting `, or 201(b)(1)(F)' after `203(b)(3)'; and
(3) by striking `Attorney General' and inserting `Secretary of Homeland Security'.

either missed BEC by luck (pre-PERM folks) or used substitute labor. They all have GCs.
And there are people like me, still waiting waiting waiting.
It is not fair on people whose labor went into BEC and others filed PERM, got approved faster - have EADs/FP.

I am kind of disappointed with the response to the idea of calling our respective University presidents knowing that there voice will be heard. All we need to do is convince the university presidents to speak for us?

To highlight other point of view and keep the debate balanced... It ain't rosy on the other side(India) either.
There is a severe shortage of highly skilled personnel in India too.
For those talents , salaries have gone through the roof. Add to that rupee has appreciated a whopping 11% this year...significantly compromising cost advantage.
attrition is a problem to get anything significant done . There are many stories of companies moving out of india due to attrition.
and for those outsourcing companies like wipro , infy etc where name of the game is pure staff augumentation/outsourcing ..... immigration issues will hit their business too.
Add to that all the peripheral issues with doing business in India ....poor infrastructure, cultural issues and overhead/risk of managing distributed teams etc ...
Pure outsourcing/staff augumentation business model employed by Indian bell weather IT companies is finally being challenged.
Simply put: There ain,t free lunch, anywhere.
IMO: Purely from career standpoint , getting a greencard and staying put in US, is still the best option by a distance.

if they've less calls, they can do some other real work.
in any case..they took 1-3 months in case of reciepting 65K H1s. How soon do you think they can receipt 10 times that number..
That was before their newly found 'effeciency'...
more recently, they took 2 days (not even working days) to APPROVE 25000 AOS applications, how hard do you think it is for them to issue receipts ? :)

-- Is there any real example on any internet forum, website or blog where someone faced problem in citizenship because they left their sponsor employer before 6 months expired? Do not find opinion but a real proof.
-- Can any lawyer provide a case example to illustrate the above. We can go into detail, talk to USCIS and seek clarification.
-- Is there anywhere in the law, memo or rulebook that says 6 month employment is needed after getting green card.

there are motivated members who cannot come for genuine reasons. we are trying to help them where we can- and they are helping others where they can. but they are far outnumbered by the "this is a forum if you don't want tracking why don't you close it" crowd. and the "who are you to ask me" crowd and " participation is voluntary, don't spam me" crowd- you know the drill.
apparently many have forgotten or never bothered to find out that IV is a grassroots organization that aims to end all retrogression. and they have a distaste for education too. after all they are "highly skilled" :confused:
