MS is just a pretext for many who are here. MS is worthless if you are a software engineer.. you don't need MS to be coding in Java or .NET...

Agreed, but still there is a quota in place for STEM graduates in H1-B regardless of the university rating/quality. The law makers/USCIS approved it - so there must be something in it that appeals to them. In my opinion, it would be much easier to work on extending this benefit to GC process as well (its mutually acceptable for both the establishment and applicants since we already have a precedent in the H1-B system). Hypothetically speaking if an additional quota of 20K is created for STEM graduates, it will help every one involved. Not the perfect solution, but probably one of the most practical and likely to be approved one.
People with STEM degrees will probably get their GCs done faster which to some may appear unfair. But under the cuurent circumstances, what other options do we have?!?Status quo which means, every one is stuck or a separate quota so that at least the queue keeps moving?

I dont see any light at the tunnel. PDs will not move until they allow 485 filing even PD is not current.
Please send the letter to WH if not already. As lasantha said, filing for I-485 when PD is not current is something IV is taking up with the administration. But, we need to get more letters to support our argument that this systemic dysfunction at USCIS is widespread and is affecting tens of thousands of people and not just a mere 1200 (that is the letters total so far and 10% of that comes from needhelp's efforts:))

there are motivated members who cannot come for genuine reasons. we are trying to help them where we can- and they are helping others where they can. but they are far outnumbered by the "this is a forum if you don't want tracking why don't you close it" crowd. and the "who are you to ask me" crowd and " participation is voluntary, don't spam me" crowd- you know the drill.

I think I have joined IV in last 3 years or so...
Donated money once & have called congressmen & senators many times ...
Could someone please tell me -
What has been achieved by IV till date? I know we all meet elected reps, officials in washington dc ..... but I am interested in end result like not wasting visa numbers , implementing spillover & along these lines.
I have asked few friends to join IV but then if they ask me for IV accomplishments - i can't count any....

If anyone of you here in SAP, Oracle apps, JDE...this might be useful. I have APICS CSCP (Certified Supply Chain Professional) books all four volumes in very good condition. I have cleared the exam today and putting it for sale. If you need please send me private message. I will donate 10% to IV. I am listing it here as there are lot of guys in IT and working in ERP. So please dont give me red.

Once people are out of this GC mess, they all start talking about anti immigration and that's the reality, u go to any indian community around and see how much support you have from those folks who have GC/US citizenship.
Hispanic community has unity. EB Community has factured groups, each intenet on their narrow goals and aspirations. There is no use commenting on and comparing Hispanic comunity with legal community. Every illegal fights for all the illegals where as every EB immigrant fights for himself and by extension his/her group be it preference category or country category

Duplicate application will definitely create problems I will told today by the USCIS rep. They don't recommend it at all and neither my lawyer. He has refused to re-file or will only re-file if I take the onus/responsibility of the result.
USCIS rep also informed me that as long as you have a tracking proof that you application was delivered, you should be able to refile after Aug17 also, in case application was not processed because it was lost or so.

She was speaking slowly, repeating stuff multiple times, adding extra emphasis on phrases (like "talking point") and repeating them. Then someone would suggest something and she will go "That is a perfect post", and then he/she will try to say something, and Donna would go "No No, what you said first was perfect, don't deviate".
I was feeling bad for the Antis.

I wish that were the case. Unfortunately visa number is allotted only after EVERYTHING else is done and that is why we have to endure additional suffering i.e. even if your case is ready for approval it will remain pending because visa number is unavailable.

A big weight off my shoulders. Much more freedom in getting new jobs. Easier to travel. Planning to buy a house finally!!!

Went out with friends and just enjoyed the feeling of freedom

The feeling of uncertanity was terrible. Had to put lots of stuff on hold, like buying a house.

I added some facts about how much I paid in SSN, Medicare, Fed and State taxes (in the last 10 years that I have been here) as well as some detail about what I'm contributing (patent pending) to this country. Another thing I mentioned was about my volunteering during the 2008 campaign (implying that I would be voting for the president's party if I ever become a US citizen in 2050 :~).

i think this still upholds the memorandum with regards to porting off on unapproved i-140. if you notice the case they have cited "Matter of Al Wazzan" is date Oct, 2005 where as the favourable Yates memo came out in Dec 2005.
what i understand is that they are just reiterating that porting off on unapproved i-140 is not automatic and requires that the adjudicator decide on the pending i-140 first before deciding wether the porting off is protected under AC21 or not.
but again...i myself am waiting for clarifications from immigration law websites like murthy.com and immigration-law.com etc.

I would say another problem is getting the H1 stamped. Ever since they got rid of getting the H1 stamped within US we have to go out of the country to get it stamped and you never know how much time it is going to take. Now due to PIMS delays some people are getting stuck for more than a month and no one can afford such long holidays .
On top of that if you are going out of the country then there are airline tickets and stamping fee etc etc which also comes in 1000's of dollars.

Pappu, automotive insurance is another area of concern. U.S. insurance companies navel gaze when it comes to prior coverage or driving record.
