12/02/2007: News of DHS Plan to Approve Immigration Applications Without FBI Name Check Results After Certain Months Stirs Confusion
A couple of sources reported lately that DHS was planning to place a cap on the FBI fingerprint check period and should the agency fail to receive the FBI report within certain undisclosed period of time, the agency will proceed with adjudication of pending immigration applications. Reportedly, the information was released at a DHS meeting with the immigration stakeholders but there are no details of information available about the so-called plan of change of course in managing homeland security matter.
This reminds of the agency's past history in 1998 acting on the backlogs in CIA clearance for over one year causing a huge I-485 backlogs for years and announcing that the INS would adjudicate pending I-485 applications without waiting for the CIA completion of the security clearance on a condition that should the CIA report indicate a negative information, the INS would "revoke" the approved I-485 applications. The people who suffered the most from the lack of coordination betweren the INS and the CIA at the time were Chinese. The INS stop-gap action stirred some political concern and short-lived. The CIA clearance backlogs gradually improved afterwards helping the INS to remove the 485 backlogs over a period of time.
Such unusual stop-gap action was taken "before" 9/11. Since 9/11, the security and name checks have presented the DHS with a challenging task of balancing betweein securing homeland and reducing clearance time. The FBI name checks have presented a serious problem of backlogs particularly in two areas: One is name check backlogs in the new hires of federal government employees and the other is the immigration backlogs. According to the CIS Ombudsman reports, in 2006 the DHS had about 82,824 backlogs pending more than one year. and in 2007 the number increased to 106,738 cases. Such backlogs induced federal litigations in the form of mandamus actions by the applicants with some successful results. The burden of such litigations on the DHS financial and litigation resources has mounted over the years. In order to deal with the problem, the USCIS one time "informally" handled such problem by approving applications (I-485 and natulalization cases) when the applicants brought mandamus actions in the federal courts. Such action had brought a boom of business for some immigration lawyers rushing to filing of a sort of "massive" mandamus actions. Obviously, this action raised a serious polical outcry for the agency compromising the nation's security by adjudicating applications without the name check results, leading to suspension of the DHS informal policy and a subsequent announcement that the agency would not give any favorable consideration in adjudication of applications where a federal lawsuit was pending.
The environment of the agency's security management indeed changed before and after 9/11 and the precedent of INS approving I-485 applications without name check results without prejudice to potential revocation of such approved I-485 applications afterwards may not be that easily reintroduced as the agency will have to overcome two hurdles: A political pressure in the upcoming national election and a potential compromise of security. There was a legislative proposal in the Congress in one of the FY 2008 appropriation bills (CJS Appropriation Bill) which mandated the DHS to adjudicate immigration and naturalization applications, should the FBI fail to clear the name checks within six months from the effective date of the legislation. Too much visiblity may not be good. Anti immigrants also will do more aggressively. Illegal immigrants also doing rally every year May 1. But they cannot impress congress though they have powerful lobby. Congress is divided based on their area people opinion. When congress changes and more pro immigrant members are there in congress then bills will be passed easily. Now the surprise is no single immigration bill is coming atleast for voting. Then only we can find whether those bills have support or not.

One of the benefits behind doing this will be, everyone in this country i has their eyes on DC for presidential elections. Hence more visibility for us.

I too spend 1500 in 2006 becasue dates were not avaialble in india at that time... ( Iremeber ( 2-3 ) months waiting was there .. and Canada has 1-2 weeks.

I just saw the USCIS GC approval email notice - EB2-I - Dec 20'th 2005 Priority Date
I have same issue as few others have. I'm not married yet. I have applied for GC and luckily the GC has been approved (when I really don't want it to be approved). ... Trust me I was praying god all the time.
My priority date is EB2-I Dec 20'th 2005 and god knows how they approved it much before every one else. When all others really want their GC's.
There are lots people who are in queue with Jan 2004 and later priority dates and whose cases are still pending... How could they approve my case so soon...
I have scheduled for a travel to India on August 15'th 2008 to get married. I wanted to marry and get my wife to USA. I 'm engaged with girl at India and all set for marriage this month (August 2008).
I believe my H1-B has been automatically canceled on immediate approval of GC.
How do I get my future wife to USA?. What are the options left out to me now?.
Please excuse me if this is a duplicate thread. I'm really in hurry and could not check all threads properly.

Well I guess one way to make a point is by having a fax, letter and email campaign to let Businessweek know that they will be boycotted.

-- Is there any real example on any internet forum, website or blog where someone faced problem in citizenship because they left their sponsor employer before 6 months expired? Do not find opinion but a real proof.
-- Can any lawyer provide a case example to illustrate the above. We can go into detail, talk to USCIS and seek clarification.
-- Is there anywhere in the law, memo or rulebook that says 6 month employment is needed after getting green card.

I am not so sure where you get the impression that being a pilot is not a glamarous job any more. If you equate airline pilot to taxi drivers, you would probabily see planes dropping from sky like raining, and I bet few would dare to take commercial airline, unless one with suicidal tendency.
However, that relates another interesting part about outsourcing: lots of people are saying outsourcing are good and you can get anyone to do the IT job, but it really turned out that lots of oursourced jobs are done so poorly that eventually it costs more for the company.
We think about outsourcing because it affects engineers the most. especially IT/software. Remember software is still a tool. What you do with the software is more important. The process of creating software is just like making any other tool (every problem is hard to solve only for the first time).
Western countries started the industrial revolution (manufacturing/factories). Now China is leading in manufacturing. IT revolution, again was started in the west. In 20 years, it is possible that very few lines of original software is written in the US. Its not that US does not have smart people who cannot be trained as engineers but more like the smart people in US prefer other occupations as compared to engineering/software.
I imagine the computer/internet revolution to be similar to the air travel revolution. Both made the world a smaller place. A few decades ago, being a pilot was a glamorous, high paying job. While pilots may still be reasonably paid, they are now perceived just like taxi drivers (with all due respect to both professions). What is to say how IT engineers are perceived as in a few decades from now. 13 years ago, a maths professor who taught us a class said "Before the computer was invented, we had a profession called typists; now they are called computer scientists".
US education system : A few months ago, there was an article that debunked the myth that 'US education is falling behind other countries'. The US education system may be a little pressured (especially in places with more population - but certainly not falling behind other countries. Just count the number of colleges in the US.
I am not just being brouhaha about the US. But just putting things in a different perspective.
H1B, GC, legal immigration are just sub audible noise in the overall scheme of things. Yes. it affects us a great deal because we cannot live unfettered lives.
On the other hand, India & China ( & Brazil/latin america & Russia) are starting to rise back (yes, each country had its own golden past - remember Columbus was trying to find a route to India when he discovered America. Marco Polo is still remembered for discovering the silk route to China....) These countries got left out of the renaissance, industrial revolution developments that gave western europe and north america an edge over the 3rd world countries.
Growth in the above mentioned countries will result in increased demand for goods and services that will benefit the overall global economy.

Along with Individual donations what are people's thoughts on advocating for and asking assistance from companies to donate to our cause. I keep reading many articles where many companies have been advocating and lobbying for this? I mean would it be too terrible if all us can try and pursuade our current employers to donate atleast 50-100$ for this. I dont know if it can be a recurring donation but even 1 time will make a huge impact on money collected.

If I was on the receivng end of that response; I would have thought that these guys are playing with me and by not answering the quesitons; then they are obviously trying to hide something. Therefore, I will attack them in another way to make them conform to the behaviour I want.
MSFT do not abuse h1b visa - they maintain their pay scales and follow all rules. When they say they want h1b visa quota available it basically means - they do not want to turn away a talented candidate because of lack of visa. All these companies are genuine in their usage. So they can definitely give a proper response.
Now for a company like INFY. WIPRO, etc.. - h1b, l1b etc.. is a part of their business modal. They need some visa to bring people in and out as it is a big part of their business. If they really were serious - they must have presented their case and also work with US govt for a different kind of visa that allows them to do their business by convincing the govts about trade etc...
Now comes the consulting companies. There are companies that genuinely bring people and rotate them at various clients for projects and people stick to them till green card. But due to sheer greed - some of these have abused the system - they have absolutely no sympathy for their acts of greed. The max they can do is threaten, usse small time lawyers, cancel pay, write letters to USCIS to cancel 140 etc... do you expect them to give a proper response to the Senators?

Examples are on-line credit card payments, rental payments, electricity, telephone, cell phone, cable bill payments, money transfers to name a few. Over period of time when you the patient gets used to these habits, he tries to extend the same logic to other walks of life. Expect results within few minutes. What the click�O�maniac does not understand is certain things in life requires some amount of time in terms of weeks and patience to complete. Even though he/she knows that USCIS is going to receive about � million applications by Aug 17th and receipting of 485 applications is going to take long time, he/she can not resist pressing F5 button on bank statement URL, USCIS press room URL, immigration voice URL, on line case status URL, email account URL and what not URLs. So, someone is trying to contact CSR every day about the receipt status, verifying if checks are cashed or checking LUD on previously approved certifications on hourly basis, it is not his or her fault. Culprit is this undiagnosed disease. If untreated, he/she may be desperate for the finger print notice date in near future. After the finger print notice date, it may be FP notice acceptance date or LUD on case status.
If treated, he realizes that how deep he went into this GC well and how far is away from life on earth and thanks his stars for not remaining as a frog in a well.
How to treat: Do your karma and do not expect results.

"jabh kismath GA***U hai tow kya karey ga PANDU"....we unfortunately get trapped with such type of employers who trouble their employees and learn lessons in hard way and looks like you haven't encountered any such experiences with your employer, if that's the case you are lucky enough & I wish you would NEVER fall into such employers hands who would trouble for so many other different reasons and this could be one way....or not sure if you should have one small experience and see how you feel just for the heck of it....

I can sit here and add as many proverb's here all day long but the point here is try to be supportive to folks who are seeking for some help rather then sharing your "KATARA" proverb's..try to improve your thought process if you can....
