Man, I-485 for Texas went back more than a month. It's so bad, they might as well not have published it, one would have slept better at night.
How do they come up with these dates? Weren't they supposed to process I-485 applications in the order they received them?
And how come the California Service Center has been doing so well this past few months, while all the other centers have been stationary or going back. CSC is at January 2007 now, fer cryin' out loud!

Need suggestion how to proceed with my new approved I140.
I have two approved LC.
1. PD EB3 SEP 2003 for which my I140 was approved and I have applied 485 during July 2007.
2. PD EB3 MAR 2002 I got my I140 approval yesterday.
All for same company.
Is it possible for me use my new I140 for my 485 which I have I filled already? I have requested my company’s attorney to find options.

Its all these desi companies who misused LC ...... Thereare otherbig companie who just follow rules and do according to it. Being a senior member here, this is not expected of you .....

5. This employer is a consulting company...(desi) & they asked me to sign a financial agreement to repay their expenses on labor substitution/I-140/I-485...if I will leave them early. ...Is it legal to ask for such kind of agreement...?

I work in a company that has got a decent name in the field I am working in. They recently have introduced a rule stating that I have to stay with the company for a year after GC before I can decide to leave for another company. Otherwise, I'll have to pay back the expenses incurred in the GC process.

The only leeway USCIS has w.r.t EADs are the duration of the EADs and not the timing of the issue of the EAD. The fact that the EAD can be given only after the I485 is filed is governed by the INA.
Further the grant of EADs in all the eligible categories is more or less the same. Even if the timing of the grant of the EAD were in USCIS hands ,it is hard to request an alternative interpretation of the regulation in some cases (eg after I-140) while retaining the same interpretation for other categories (eg EAD after completion of Education). This just opens up a lot of loopholes.
ON top of all this we have to take into consideration the huge inherent inertia of the USCIS to change. As already pointed out the only recourse available would be to change the law of the land, on which path we are already traversing.

It would help if Masters is only counted from the Acredited Univs...
I am sure they will take care of that loophole... the fact is , even NJIT is an Accredited University. The Degree is not worth the paper it is printed on though.
In any case, as long as its not an Online degree..it should be permissible.

I agree with you. I had also brought to the attention of the moderators about the restraint they need to exercise while closing threads.
Let people discuss about the visa movement dates as long as it doesn't harm/hurt others. Discussing/predicting visa dates is not against the wishes of the larger immigrant community as long as anti-social acts like betting is involved.
I again request the moderators to exercise their power with proper reasoning. If 1000 people wants a thread closed, it is not a proper reason for closing it.
I normally don't post predictions. But I read it sometimes. They will be a few people who post genuine opinions. Their views are sometimes helpful!

I was thinking how to get a high tec job with Z visa. Because you might need to tell the employer that you are on Z visa. Tech employer might be hesitent to give us job on Z visa.
But you can start a new company and do consulting. You do not need to tell them what status you are in. All they need to know is you are a employee XYZ company.

Is it out of status if one gets paid from 2 companies with
2 H1bs , like, If one is on bench but getting paid by that company, starts working with 2nd company on transferred H1b, so it is like double pay for about 2-3 weeks .
If you're getting paid while you're on bench with Company A, and Company B has transfered your H1, and is paying you as well, that's not a problem. The problem arises if you're on bench and are not getting paid. On H1, one has to be paid even if he/she is on bench.
Hope this helps answer your question.

Transit Visa need to Travel Via-Germany if you don't have valid Visa or Travelling on AP.
Please who are travelling Via---> Germany should hold Transit visa, if they don't have Valid US Visa or using AP.
I believe this rule came recently, please see below link of German Consulate Website for more information.
German Missions in the United States - Transit Visa Country List (http://www.germany.info/Vertretung/usa/en/04__Legal/02__Directory__Services/01__Visa/__Transit__Country__List__Visa.html)
This applies to people who are going to India to get Visa at Consulate in India too.
If any one is Travelling Visa- Germany (Frankfurt/Munich etc) please take necessary steps.

There is 200k application without 140 approval, this is including july filers.
there is lot of chnace for those who got their I-140 approved, even their PD '2006.
you can see people getting approved PD'2005 EB2 cases, even then VB says now 2004'apr for EB2.They are not processing based on PD now and in future also i gues.Since we have already filed.PD will restrict only to File I-485 in future.
I think EB2-jan2007 and EB3-Aprl2005 in October VB

I completely empathize with you, salcom3. My daughter is in similar boat.
Apart from what IV might do, each of us should write immediately to as many Senators and House Members as possible with our own story, pointing out the unfair treatment of those who are trying to play by the rules.

Here is my daughter's case:
1994 she was 8 years old when we brought her to USA
2002 asylum case was denied, we had to go back to our country (we didn't stay illegaly)
2002 after one month we came back, with H-1 visa, daughter with H-4
2003 I applied for LC
2006 My daughter turned 21 - She had to change status to F-1 (of course college fees were triple). She is out of LC process because of her age.
2007 LC approved, she is still F-1 and paying a lot of money in tuition.
I mean, these kids like my daughter (and I am sure there are thousands like her), deserve a break too. If the DREAM ACT is going to benefit illegal persons, it should also benefit children that have waited for their parents' LC process for long years only to see their hopes destroyed.
