One question for you
Can A2p the wages be pro rated ?
if monthly wages for an employees is 1000 per month then it should be 12000 per year) company need to prove the ability to pay $12000 per year.
but what if the LC was filed in mid year for example June 2005 and CIS RFE is asking to proof ability to pay (only One year) 2005
can it been showed as June - december = 7 month and onwards
$1000 x7= 7000
is it good approch or no

Last week i received RFE for my wife's father's name. The name on birth certificate is different from school leaving & other docs. I'm trying to get it corrected from Mumbai.
I beleive if i get a correct one matching with other docs, i should be ok.
Another issue, i have is i have rented an apartment under my name close to my work in the same state. All my docs have my home address, my question is will it affect my case if they find another address under my name?? I still have official address as my home everywhere...
Yes you need to make sure that all documents have consistency in names and dates. As far as your second question goes USCIS has space for just one address which should be your current address. So as long as you can prove that the address listed in CIS system is the most current address then you are fine. There is no law or no way to provide multiple address. Just make sure you can prove that address on file is your primary residence.

Also in NC, the DMV rules are changes to issue DL untill the Visa Stamp validity in PP, This will be an issue, if you extended your H1, but no valid visa in PP. Would recommend getting this done via internet.

I am currently awaiting approval for my I-485. My priority date is August 2006 and I completed fingerprinting on Oct. 29th.
I understand the process of allocating green cards based on employment-based category and queuing based on the labor/priority date.
My question is regarding COUNTRY LIMITS. What role do these limits play in the approval process? To be more specific, if the applicant is from a country that has a very low number of GC requests, does the fulfillment of the country limit take precedence over the priority date/EB category or does it succeed the latter?

That should be straightforward to do using buttons and a scrollviewer. The two buttons would be for the Left and Right arrows, and the scrollviewer would be the parent container for your images.

Supposedly there is the AC21 form, is there an example how this form should be filled, and what other documents should be included? How long does it take to approve? (for driver's license, traveling, etc.). Does it have to be filed with H1B extension?
The new job offer is 25% pay increase, otherwise very similar, could that be a problem?

Make sure that your new reporting manager is aware of your GC process. I had a manager earlier, who midway through my LC process decided he will not support the GC, since he was not my manager who hired me, since i was moved to another group, after my LC was filed...........If needed go up the ladder for buy-in

Me and My friend developed a product, which is ready to launch. The product is very good and two fortune 500companies are willing to implement the product and back us up.
Now my problem is I am on H1B working fulltime with a company and also have an EAD. At this moment I cannot leave my fulltime job. My question is , if I can be a partner with my friend in the new company we are forming( My friend is a US citizen), also will I be able to get paid ( as the developement of the product drained my pocket, this was the hope and I think we are close to reap the hardwork) . Also my wife is also on EAD , can she be the partner? Will there be any issue if I can do that.

This is a much talked about subject around these days. I am sure many of us who renewed EAD but had a gap in the expiration and renewal date and were on a leave of absence. Would this be a problem when it comes to the GC processing?

yes, your employer can file for a new H1B, but you will have to leave the country and get a visa to work on the H1B. An easier process would be for your new employer to take over the sponsorship of your GC by using AC-21.

Never give childcare as a reason. INS treats this as employment for parents. But religious ceremony for child may work. For medical stuff, I'd say that you need to show that either they cant travel or they are under some treatment here. For both the reasons, you need a US doc to write a letter. The best reasons are travelling to different places in the US.
