You could have asked for the old I-140 priority date to be tranferred to the new I-140 at the time of filing the I-140. Now that the I-140 is already approved, it will be difficult to get them to make any changes on an approved I-140. Interfiling of new I-140 with old I-485 is possible once the visa number becomes available. The problem is that USCIS does not always acknowledge that they have done this, therefore you might be unsure if this was done or not. Some people prefer to file a new I-485 for this reason.

My current situation with Company A is:
1) I-140 approved in August 2008 (total > 180 days)
2) I-485 pending since July 2007 (USCIS receipt date of September 29 2007)
3) EAD valid till October 2010
4) H1-B valid till October 2010
5) PD: Feb 2007
Company A is in talks with company B for takeover of the division I am working in.
I have a offer in hand with company C. They have filed for ETA 9035 and if i understand it right, i have to use AC21 portability now
What I need to confirm is:
1. Takeover of company A's division by company B, will it affect my GC process? What can cause issues here?
2. If i stick with company A, it should be good for now, but maybe some layoffs after merger. Whats the best thing to do to maintain my GC process?
Please let me know as my join date for company C is next week

Who would be better to handle a complex GC case Murthy or Rajiv's office.
Any experience? I am looking for somebody who is responsive and can handle difficult queries from USCIS, if need be. How much do they charge for complete EB case?

You must have I94 showing H1B classification and validity dates to change status to H1. You can travel and re-enter with a H1 visa stamp and obtain h1 status. Please check with the company attorney,

Hi,
My attorney had filed our 485 at Nebraska SC on July 30th. She didnt file EAD & AP.
On August 10th I myself filed EAD & AP at Nebraska SC. I got receipts for AP. For EAD, they have sent back our docs saying that 765 has been filed with improper fee (guy who picked the file is not aware of July VB fee valid till Aug 17th). So I have sent back the documents with a cover letter stating we come under July VB, after a week they sent back the packet again with same reason to file with proper fee of $340. I dont want to waste time and energy.. so this time I have sent $340 and after a week on Oct1 we got receipts for EAD.
Mean while I called USCIS to check the status of my 485 and luckily got the receipts numbers from them. The file has been transferred to Texas.
My questions are:
1.The received date on the EAD receipt is stated as September 27th. But the very 1st time we filed was August 10th. So would they treat our file as that filed on August 10th or Sep 27th???
2.My EAD & AP are at Nebraska and 485 is at Texas..would that cause any delays..concerns?
Anyone been thru such experience. Please throw some light.

My I-140 is applied during Jan 2007 under EB2 category. My LCA says Masters with 24 months experience amd alternative as Bachelors with 5 Yrs experience. As per the processing time updates, they are processing March 21st 2007. I don't see any updates other than Case is pending.
What should I do to get this processed?. Should I call customer service and ask for SR?

My wife and my infant daughter originally came to the US in 2004 on H4 and my wife got her H1-B also in 2004.
In Oct 2007 I and my wife got our EAD (The GC processing is through my company). Also since our arrival to the US in 2004 we did not go to India . But we are planning to go this summer.

But my company & their attorney are not sharing any details..
Left with no choice.. but to wait with hope..
Better to start new labor process if your are nearing 6th year on H1. these audits take forever and mostly have -ve results. and the employers/attorneys are not helpful either.

I am assuming that you are planning to change employers when you change from H1 to L1.
L1 is only for intra company transfers and you needed to be working with the company for atleast 12 months (used to be 6 months till not long ago) before you are eligible to come in on an L1.
If it is with the same company, that you plan to change from H1 to L1, what is the advantage other than skipping Labor certification if you are on L1A?
If you are on H-1, you cannot apply for L-1. You would have to work for a company outside the US for a period of 1 year before you can apply for a L-1 assuming you are in the US currently.

-> I entered country on B1 and I applied for H1 through other employer. H1 got approved but change of status is denied as i left the country while petition was with USCIS.
-> I entered country on B1 again with new employer who applied my H1. My I94 validity ended on October 24th and we applied for extension due to some show stopper. Application is still in process.
Here are my questions -
1. Can i apply for change of status now or do i need to go back to India?
2. Now that i applied for extension, if i go for stamping at India immediately, will it be positive? Just because, i stayed for almost around 8 months in US this year. I was just wondering, will they reject it raising doubts on my intent? No one can decide on it, but what are the chances?
3. Staying in Canada on work permit for 6 months and then leaving to India for 3 months and then go for stamping, is this a better option?
