I believe there are always two camps in any group, different view points, ideas and observations.
I firmly believe even if words are harsh from some members they donot mean that bad, or they just simply cant see other's view point.
Over last few year, i have observed something and that bothers me, the point is
"We (Indians) are interesting people, we want to live as an indian in america";
save a lot of money, go home(india) for 15 days ....say bad things about india
and then come here...start saying bad things about america.
Nothing about this behavior is specific to Indians. It is a first generation immigrant behavior. See if you children are going to do it...
I like some points aobut half hearted work from some fellows. I totally agree.
Here is my simply take, if we want to live and compete hapilly, we have to really live in america as an american.
How can an indian who slept all afternoon on weekend, then watched a movie and ate heavy dinnner at night with 5 indian families who all taked about negative things in america; will /can compete with american on monday morning...when this american
got up early on saturday, ran 10 miles ...full of energy....took his/her kids for camping or went on its own, ran /exercised on sunday may be a long trek in woods...he is fresh, ready to work, creative...
I donot think anyone who slept all week/watched movie/talked negative about american society /about america can compete with someone who lived for full weekend.
Really? An active lifestyle, being outdoors, energetic etc. are qualities of an American? A country where 70% of people are supposed to be overweight? Where some say 30% to 40% of schoolchildren are obese? I would agree with your argument for an active lifestyle versus a lazy one. However generalizing to things like getting up early/running/trekking/outdoorsy etc. as typical American traits is pushing it.
If I want to catch up on my sleep on the weekends, why not? I sleep less than 6 hours a day on average during the week. Sleeping less = poor output and also has been linked to poor cardiac health.
These are just small observations.
In short, most of us are still living an indian life in america. This will not take us far,
If we want to be happy we got to live as an american in america.
Money is not everything,a big bankbalance will do no good to anyone at age of 65 when you cant move your leg let apart run or play.
I also believe, we (indians) donot give time to ourselves. Ex. husband, wife, kids all together all the time. No good, give time to yourself, do somtihngs togehter and some things seperately, This will give time to observe life as an individual too.
You dont have to blindly believe that everything that is American is good.
For example, Americans work the longest hours of any developed country. Does this increase your standard of living. They have the fewest holidays/vacation days.
Maybe doing things separately is your "American way" of fun. Doing things with my family is my way. What's wrong with that. At least we dont have a 50% divorce rate and dont kick our kids out of our homes when they turn 18.

I like pursuing option 3 and 2 at the same time. We don't know if option 3 requires a law change so need to clairfy that. While we prepare the slides/etc I think we should contact USCIS first and while working with them educate the law makers on EB3 category based on the points similar to below.
The fact that EB3 category requires less experience than EB2 shouldn't be looked at as EB3 applicant is less skilled. Infact I have applied EB2 twice and now in EB3 and I do have US masters and 10 + years US experience. It all depends on company's attorneys comfort level.
It shouldn't be viewed as we are taking visas away from EB2. Infact we are requesting realisitic approach to the skill sets. Instead of EB2 Current and EB3 at 2001, EB2 can be couple of years ahead of EB3.
We can come up with many ways to explain the injustice but it is time we ACT. I am with you on this.
Lets not get sidetracked by Mr Skillz with a Z.

Option 1: CIR - This is not in the picture right now. Nobody knows when this is going to happen and I think we should not even bother to look upon this as a short term measure.

* Collect and consolidate all the data in a spreadsheet from the latest 485 inventory to the yearly reports of adjudicated cases
* Create a what if analysis for the next 3-5 years for EB2 I and EB3 I
* Create analysis to show what will happen with the old rule and changed interpretation of spill over
* Create a nice presentation
* Contact Senators, congressmen, USCIS and walk them through our presentation
Hopefully that can change their mind or atleast we gave our best shot.
Add your thoughts and inputs and let us create a plan on executing this, if folks want to do it.

I have mixed opinion about that. Say, hypothetically she attends rally, then everyone is going to think that she is biased towards legal immigrants.
It would be better if people looks at her as a non biased person, her word is more powerful that way.
Its just my opinion.

I am in a similar situation. My wife who is on H1B did not worked till date.
Is it possible if she carries the vacation letter from the employer and go to India for H4 stamping? My wife do not have any paystubs.
I have also contacted my attorney and waiting for his response. I am running out of time due to the GC priority dates being current. If the attorney does that while she is in the country, it would take around 4-6 months. By then, the priority dates might be retrograted.

It will be very difficult to argue unpaid vacation for > 50% employment time. There is alawya a risk of getting Change of Status approved without I-94 and could result in I-485 denial if out of status > 180 days.
Out of Status is NOT an issue for H4 visa stamping.

You have to start all over if you find a EB2 qualified job and also if you qualify for that job,and your prospective employer couldn't find a qualified US Citizen or permanent resident for that job, you may port your current PD at the time of new I-140.

Otherwise, I sincerely believe even after I get my green card, we should focus on resolving this green card backlog mess and if we can get green card holders and US Citizens to support this cause it woule be better.
Maybe you are not able to relate to what EB3 candidates go through. Yes it is a choice we made to wait in this country. A lot of EB3 people qualify for EB2 based on their qualifications and experience but were put into EB3 due to company's choice or attorney's mistake.
But no person should be made to wait for an answer of whether their application is going to be approved for 8-10 years.
The pre-adjudication in my opinion is a farce as it was more done to get their(USCIS) inventory calculated properly than ensuring the person is clear from all angles. Because, I know of about 5 people who are in EB2 who are sent RFE's now, after their dates have become current. They were supposedly pre-adjudicated as per the IO during the interview at the local office. some of them were fingerprints, some of them just to verify whether the husband and wife are still married etc.
Coming back to my point, there are EB3 applicants now who have a priority date of 2006, 2008 2009 etc. Can we accept a process which asks people to wait for 20 years to get a Yay or Nay for their application is the question. I think it is unacceptable. I believe more green card holders and US Citizens who are deciding to put their roots in USA should help the country to better the legal immigration system first before anything else.
Regarding citizenship as I mentioned before if you think you will not bail out after starting a campaign, then go ahead and lead it.
Let us not criticise any one further and look for very efficient way of presenting this to the right people.We welcome more ideas from other members then we will consilidate them and decide how we go with this.

What form does your brokerage firm send you at the end of the year? Is it a 1099-INT form that records your profits for the year? What if it were a loss. Do you still get a 1099-INT.
An H1B working for a single employer will have only one W-2 but he / she may have different 1099-INTs from savings accounts / trading firms etc for filing taxes. This should be ok, correct?

Plan to attend 2011 advocacy event.
This was in 2007, there is no rally in 2011 (just powerful advocacy from grassroots), but every thing in here holds true today too.....

(1) What's all this? Immigration Voice? Rally? Why should I care?
A. There is a political angle to issues that we are all facing. The
system was designed long time back and has not been flexible and with
the actual demand more than the capacity it is in a messed up state.
No one has made attempts to fix the mess and vote bank politics are
creating further mess.
(2) Why no one talks about these things?
a. The nature of this issue is very complex. Unless one falls into
this pit, the nature of this issue cannot be understood
b. A lot of people do not want to handle the truth and reality
c. Perception - without looking at the real picture, lot of people
assume things are fine
(3) Why should I take these issues seriously, my lawyer will take care
of these?
a. Immigration lawyers assist and handle the paperwork, this mess is
beyond their control or scope or even the scope of USCIS and related
government agencies
b. Immigration lawyers are your service providers and you are their
client, they will talk only business to you, there is no need for them
to explain to you the mess you are in
(4) After the July visa bulletin fiasco, I did submit my 485 petition,
and I will get an EAD/AP so why must I bother?
a. EAD/AP were designed to be interim benefits (only for few months
until someone can get a Green Card), their usage has limitations and
will lead to further issues
b. Severe retrogression will hit in coming fiscal years. India, China,
Mexico, Philippines, Eb3, and eb2, and ROW eb3 will all be affected,
c. Anti immigration lobby is targeting H1b tech workers, at the same
time a lot of lobbying organizations are working hard to make the
system unworkable for e.g.. Durbin Grassley amendments may appear
anytime
d. Until you get a Green Card in Hand, EAD is not the best viable
alternative for work and AP is definitely not the best travel
document.
(5) Why Immigration Voice? What is the agenda?
a. Immigration Voice is the only grassroots organization working hard
on these issues
b. Immigration Voice's earlier campaigns were a huge success and sent strong signals to government agencies and law makers
So why not start working on helping yourself and helping your fellow
immigrants?

So, from what I read in this thread:
* EB2 (India/China) may not have MANY cases with PD earlier than 2005 as only after retrogression (in 2005), EB2 started piling up.
* Most 2001/2002 EB3 cases are approved (in June/July/August 2007) and they may be still receiving approvals off numbers reserved for them in June/July 2007. Hence, the natural movement for EB3 to 2003 in the near future.
* If most of the EB3 cases filed in June/Juy are not processed by USCIS by next June (2008), then PD may become current during the last quarter of FY 2008 (or atleast to end of 2006). If enough cases are approved (and pending for VISA numbers), then it may move only to 2004 or early 2005.
* EB2 - same logic as above - it may become current or move to early 2006.
Makes sense?
