Perhaps - if we show that India can benefit by 1 Billion $ worth of H1 folks Social Sec Contribution for India's development, might either US Govt commit to returning the money or make provision for quicker dispension of GC cases for H1 folks waiting for GCs... As far as I know, nothing that is being considered in the Senate is going to relieve the Green Card backlog.
They have plans to eliminate the backlog in 5 to 8 years not immediately. So if one chooses not to re-apply under the new point based system, waiting time doesnt change much for him. (It may be become worse because they are cutting down immigrant visas in EB category from 130k to 90k)
But if one decides to re-apply under the new point based system, things may become faster.
I am hoping that under the new system, they will give some priority to people who already waited for a significant amount of time under the old system.
This is just my analysis based on the articles I read on the internet and the bill text itself.

I plan to use AC21 and apply G28. Any reasonable lawyer recommendation in and around bay area would be of immense help to me.
I tried Payal Singh and she is charging $1200 for AC21 and G28.
I checked with Arjun Verma and the cost is $400 for the same.

I have H1 from a consulting company.Now the client I work for has asked me if I'd like to join their company.The problem is they won't sponsor H1's.I'm willing to talk to an attorney and pay expenses for transfer.Can someone tell me if it's possible.If yes then what are the supporting documents we need from the client to transfer?

On Monday USCIS was showing that my EAD card has been ordered and today it changed to Approval notice sent....
What is the difference between these two, anyone?
I know both of them sound like music to my ears but want to know WHEN exactly should I be expecting the actual EAD...

Sure can! See the tracker. There is at least one person who filed in Texas and has his/her EAD approval date before the Finger Printing date
I also had got my EAD way before my 1st FP - but that was in 2005

Microsoft OS does not take greater than 2036 for some reason. I am not sure if folks use common sense, it is better for u to follow up to get it corrected, if they used common sense, you will wait AEO or something like next generation dinosaurus age for a GC :-) may be u have a futuristic PD :p
I just noticed that the I-140 my lawyer submitted 3 months ago to Nebraska has a typo in my DOB (21/07/2978 instead of 21/07/1978). Yes its a thousand years out! A copy of my latest I-94 and visa both showing my correct DOB were also submitted with the I-140.
Do any of you guys think I'll have the I-140 rejected, recieve an RFE, or will the Nebraska officer just use common sense and amend it himself? What do you reccomend I do if anything?

I paper filed my EAD at NSC last month. RD was 23rd Sept & ND was 2nd Oct.
Looks like yours is a longer delay. Not sure what can be done here. Please keep checking to see if check's are cleared.

I think we need reform. Current H1B system is employer dependant and make us slave. There should be more breathing space.
Something like HSMP should come. In particular, the Fresh gradutes should be allowed to start their career in a honest way, not with the manipulted resumes designed/manufactured by almighty desi consultants.

when you are applying for I140 - You may get RFE due to the fact that your education is not matching (equivalent to) 4 years. So it is better to show the education as 4 years ie..if you have some other degrees/diplomas along with your 3 years degree. this has to be mentioned in box#15.

Hello All,
Here's my situation below:
I left Company B and applied for H-1 Transfer with Company C (premium) while this case is pending i got a very gud offer from Company D and wanted to me join ASAP. While i was waiting for approval for Company C yesterday i received Query on H-1 Transfer for Company C.
Has anyone been this kind of situation before. I do not want to loose the opportunity from Company D, is there a way Company D can apply for H-1 Transfer with Receipt number(H-1 transfer for Company C).
Please help its very Urgent.

Hi,
I am presently working on L1B for company A. This year Company B applied for H1B and same is approved received the approved letter with I-94.
Now I would like to continue in my current job with Company A till I find long project (Minimum 6 Months). My question here is can I continue in my current job after OCT 1st in my L1B Status.
If I want to continue in L1B status what should I do? As of I heard if I travel out of the states and reentered in US after OCT2nd on L1B visa I can continue with L1B status. then what happens to my H1B status? Can I directly move to H1B status when I find a project from Company B?
Please let me know how I should proceed to keep L1B and H1B status valid after OCT1st?

You are safe. Once you have reached I-485 stage, it is all about you and not your employer. You mentioned that you already changed to a new employer. Technically, your old employer should've revoked your old I-140 after your move. Since, you moved to a new employer you are indicating that your new employer also has a new job that matches your initial Labor application. You have nothing to worry about your old employer closing down.

I had an EAD (OPT) soon after I completed school in 1999 and after that I switched to H1B. I am now considering filing an EAD: Should I file a New or a Renewal EAD? Thanks.
