    What would happen to those in EB3 but havent filed their 485 yet, or prospective EB3 applicants who havent filed for labor yet? Not all jobs or applicants qualify in EB1/EB2 category - to hell with them?? :confused:

    I needed to confirm my address change.. called uscis and I was told they can't see any personal info... basically read me my status on website and a long boring standard message.. saying you are within the normal processing dates and blah blah... Bottom line I was suggested to take infopass.. so I took.. Its my first infopass appt ever and it was very easy... shown me 2 dates avaialable for Aug (nothing in July).. So I pick one and then was asked to pick a time...

    I selected as a follow up on pending case...

    Hopefully they'll process my AOS before that :-)

    EB2-I June 2004... PD current, RD current per both NSC/TSC...
    Case filed at NSC and transferred to TSC (July 23, 2008)
    Keeping my fingers crossed per 50-50 probability theory :-)

    Yea. Thats true. I will think about it. It is possible to receive receipt in one week under normal circumstances. When I had applied for 140 (Regurlar Processing) in May before the fiasco I received receipt in 3 days.

    Interesting is they say "you may have trouble coming in" but for valid h1 holders it should not be a problem (wasn't for me..i traveled). They didn't say anything about "it will be considered abondonment of AOS or have negative impact on it"

    hi, first, I'm not trolling. I have a genuine question and I'm looking for answers seriously. I got laid off in 2009 while on a h1b and then for one reason or another, stayed back for 8 months. My understanding was that I could have gotten a new job within 6 months and then switched over my h1b. I was foolish. My I-94 on the h1b approval letter however had an expiration date of October 2011. By the time 8 months had gone by, I decided it was time to give up hope and return to my country.

    Since I've been here, my parents have started a campaign to get me a bride. Arranged marriages are part of my culture, and people marry based on how good a match it is according to one's birthchart. If I do find a USC who is willng too marry me, will it help me in any way immigration wise? Or will my 8 months out of status stay in USA chase me for the rest of my life?

    Hello,
    I will be getting married to a H1 holder in India and because of the time involved in obtaining a marriage certificate, am planning to leave shortly after the wedding with my existing B2/tourist visa. What are my options of applying for a H4 once I do that - would I have to come back to India to apply for that, or can it be done from Canada/Mexico - are there any risks pertaining to intent of travel associated with such an action.     My lawyer sent out the LC Substitution/140/485/EAD on July 2nd and said that all these can be filed concurrently and he wanted to take advantage of the dates being current.

    I read in several forums that it's necessary to have the LC substitution stage completed before filing for 140/485. Is this true?

    Is it possible that there are more chances of LC substitution denial? If so, what are my options?

    First off, thank you for taking the time read this.

    Now I did see a lot of discussions around this topic but could not get a real answer to my situation, Can someone please help me understand this better.

    Currently working for the same employer who started my GC process, Labour applied and approved in Sep 06, I-40 approved in 2007, 485 pending. I'm with the employer for 6 years now. I have a masters degree (MCA) but the job does not require a masters when I joined. I have my bachelors (both 3yr degrees from India). I have close to 10 years of professional experience.

    Do I qualify for the port, assuming my job does not require masters degree. Thank you all in advance.

    I'm wondering if there are any successful cases where CSPA and the Patriot Act were combined to ensure that the child remains under 21? My son's name has been deleted from the derivative beneficiary's list, however, he can remain eligible under this F-4 petition if the Consular calculate his age with Patriot Act 45 days. In that case, he can benefit from CSPA. Our case details as below:

    Priority Date: Oct. 16, 1996
    Approval Date: Dec. 4, 1996
    Days of Petition Pending: 49 days
    Child's 21st Birthday: May 31, 2007
    Child's age when visa became current: 21 years 62 days

    Also, you can see, EB1+Eb2ROW has s always been in the 50-70K range every year

    thanks for the info. Since he got I 485 approved the GC status already began for him or only on receipt of GC his Green card status begins.

    A good attorney would never recommend job description in such micro terms. What does your labor certification say ? Match it as much to that one. CIS is not concerned about that level of micro detail (servlets or XML). The description should be a a level that can be easily understood by an adjudicator.

    my current H1 employer is least helpful.i am getting worried and would like to continue in L1 for few months until i get a suitable opportunity.pls tell me how i can do that.

    Consular processing is requesting that the H-1 be approved and you will go to the consulate in your home country to pick up the visa and come back on a new H-1, in this situation, you are not requesting for a change of status when you file for a H-1. Your attorney will know how to file a consular processing case.

    My I-485 AOS thru my Husband's I-140 is pending right now.

    Recently My sister's Approved I-130's priority date is Current, So now I Can file for AOS thru my Sister's I-130 also.

    My question is :

    Which is better Interfile or new filling ?

    What are the advantages and dis-advantages of both ?

    If I go for Interfiling and If My Application is not approved thur one track (I-130 / I-140) will my application be pending for another track ?

    HI Folks

    The reason for this post is as usual- too much confusion and no clear answers. i read on oh law firm that if you are not in a non-immigrant status i.e are working on EAD, there should be no gap in your EAD while you are working. Meanin you should stop working if your current EAD expires and your new EAD is pending- otherwise its a violation of law and provisions of 245 do not protect you because technically you are NOT a non-immigrant.

    Is that true?????

    Now, i recently had to go to India for an emergency, and had to come back on AP- did not have time to get my H1b visa stamped. I asked at the immigration counter if my H1b is invalidated and he told me it is. I spoke to my lawyer and she told me if you resume your H1b employment with the same employer- you are back in status- i kinda did not buy that though.

    Can someone please shed light. My concern is that my EAD is expired- new one is pinding. Although i was on h1b when i left for India, but came back using AP. Am i breaking a law by working??

    If you resume the job you were doing before you left, you do not need EAD. If you switch employment, then you have to use EAD.
