...that my daughter just got approved for a two-year EAD even though she will, in all likelihood, get her green card in October. I checked with my attorney who said it seems they are giving two-year EAD's to everyone whose PD is retrogressed at the time of filing. It might be interesting to monitor the approvals for this?

Hello Gurus,
I have a question as follows. I was with an old company and transferred the H1 in the 9th year to the new company. I already had my Labor and I-140 approved with the old company (EB3-I Category).
After switching to this new company I had to start my PERM all over again as I missed the July 2007 boat and could not file for I-485. My new company is based in L.A.-California. I am already drawing my salary from new company. They only have office in L.A. I work for them from my home office in NJ. Today the company's attorney called & asked me that I needed to have L.A. residential address as it is required to be stated on the application. I have no intentions to move to L.A. in near future. I am in a fix now as to how to go about this. I will appreciate all you gurus and experts advice and also please advise me repercussions if any.
Please help.

My suggestions:
1. Combine labor certification and I-140 into a single process. It doesn't make sense to have two stages for employment based petition.
Advantages:
Candidate will know the result in a single stage. Once that stage is cleared he will know he is good to go from an employer perspective. Right now even after clearing Labor stage one is not sure what happens at I-140 stage. This leads to more uncertainty, worst case he will have to restart the GC process again if 140 stage fails after waiting for couple of years.
2. Ability to Pay requirement should be only for a few years ( 2- 3 years) from the priority date.
Right now if DOL/USCIS takes its own sweet time in processing perm/140 cases ( as happened for July fiasco cases), employer has to prove ability to Pay for all the years from the priority date. A company can close down, can go bankrupt in a recession during these long years. We have seen big wallstreet firms go belly up in this recession.
3. Pre-adjudicate all 485 cases within 18 months from the day it is filed. Once pre-adjudicated, the case should be accorded a FINAL status which means all processing requirement for the case has been met and no further RFEs can be issued on the case. Online status of the case should reflect the FINAL status.
Right now backlogged country candidates has to wait for a long time in uncertainty due to the current process. Once this change is implemented, candidates can have a peace of mind and guarantee that they will get a GC once visa number are available.

This is a thread that has no relevance to IV or the community that is suffering from retrogression, especially if you are a EB candidate from India & China. We need some energy devoted to the following:
1. Multi year EAD/AP
2. Recapture wasted visa numbers
3. Eliminate counting dependents on the Adjustment application from numerical limitations
4. Do away with country limits
If we can hit the target with even ONE of the demands above we have a won a battle with the larger war on looming in on us and that is successfully surviving the GC tumultuous journey.
Every discussion on the forum should concentrate on solving one of the issues above and the concept of citizenship after 5/10/15 is total nonsense.
There is no harm in adding this also as the fifth item along with the existing 4 items. :D

While i am not sure about the rumor. I certainely know that state dept can publish supplement bulletin any time of the month. For that matter in the last 3 years they have done that atleast twice. One was when the nurse numbers 50k where released in may 2005, they issued a supplement june bulletin and created a seperate category. the second time was when the same quota was over.

On my wife's labor certificate, it is said her position requires a minimum of master degree. But the alternate is bachelor degree plus 2 years' experience. The lawyer has filed I-140 under EB2.
We are worried that this position does not qualify EB2 because we read on the internet that EB2 requires master degree or bachelor plus at least 5 years' progressive experience. We called the lawyer and said we heard from a friend such a case had been denied. She was very busy and just said there was no problem to apply for Eb2, and if we doubt it, we can hire our friend as a lawyer. We are so pissed off.

I think all the backlogged labor applications are going to clear. But people like you may get very less time to apply maybe 15 days. My advice to you.
Start preparing to apply if you have not started already.
1. Do your medical exam. It is valid for 1 year.
2. Collect important documents. Birth certificate is most important.
Has to have .
a. In English
b. Need to indicate that has been prepared from original registration record.
c. Need to have your name,both parents names,
d. Registration date with date,month,year.
3. Fill up your forms.
Dont be dejected.This is the time for action.
Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

This is the precise reason I am staying away from IV, people just dont show any civility in the forum discussions and starts name calling or shot down the people who ask questions.
If IV comes up with just one single GOAL of reducing the curent EB backlog for the restorgressed categories, people even from RoW countries will start participating in IV campaign and support IV's advocacy efforts in terms of their donations and volunteering for IV.
Reducing the current EB backlog will help everyone.
If every member decided to be respectful of each other (even when some one is not), then civility would not be a problem.
However, that is not the case. Members sometimes take things personally and expect IV to micromanage the forums. In the current situation this is not possible.
1. IV is asking money for advocacy efforts and we are unable to raise the money we set out. The money goes directly to the advocacy.
2. IV can do the micro managing, then we need to raise more money - to pay for the people - which means members have to pay more money regularly to pay consistently for the people working and for the year round advocacy.
3. IV is doing the good work (if I may say so). I wrote earlier, that if any member had a question on IV and its workings, all they have to do is call up - you will find out about what we do directly from us. But I am yet to hear a phone ring on that reason. You can make up your mind on to support us or not.
4. Holding every member's word as that of IV is unfair and unrealistic. Please refrain from it.
Again, if we decide to be civil to each other, we solve this problem. That is an individual choice - that each one you (and us) have to take.
Debate about a problem and try to find a solution. But asking people to convince anyone of anything on open forums is not realistic. If members are so inclined to believe in a cause, they will find ways to learn about it and work on it.
Volunteers of this organization are just like you. With jobs, families, financial constraints.......
You - every member and not directed at any one particular member.

My EAD has been pending for almost more then 60+ days. I have got my FP done almost a month ago. No LUD's nothing.
When i tried to get some information calling the 800 number, they wont talk and say that the information on the automated system is the latest.
Has anyone been able to talk to any IO and get any information about their case. I am working on EAD and it will be expiring in another 45 days or so, i am just getting worried.
Any help will be appreciated.

We should not talk any where close to 10 /15 years waiting time as that is not what current system of citizesnship talks about.
Also marriage based GC already has 3 years after GC rule so it may beeasy to get it.
Making it more complicated like Percent credit for before GC filing, after GC filing, after getting GC May become hard and complicated to convenince politicains who might be amending those rules.
So Keeping it simple - 5 yr federal taxes, MS or higher in STEM, 3 years after GC - you get citizenship (all of these has precedents)
IV Core team, have a look into the valid and genuine ideas on citizenship in this thread and try to include them in the phase 2 campaign. For our long term vision & goal, this should also be a part of our campaign.
