did you emailed to ombudsman also? any replies from him?
While a lot of people sending generic letters on this issue would certainly bring the underlying issue to the discussion table - the lack of "locus standi" would prevent ombudsman or even USCIS from acting.
Let me explain what I mean by the above statement - every case is different and is adjudicated according to the merits of that specific case alone based on applicable laws and procedures. So, investigation and even future policy direction can be only be based on specific instances of the entire case files and detailed specific reasons of how these cases were wrongly adjudicated.
So, the service centers and even the ombudsman is right in saying - we cant help till we have actual case #s

Thanks Ramba for the analysis. Kudos to you to bring out the true fact regarding the spill over. I see you are belong to Eb3 ROW category but still you stood for the truth.
Lot of analysis. Here is my part. If DOS properly followed the INA as amended by AC21 act in 2000, EB2-I never retrogressed since year 2005. EB2 I might have been always current. EB3 including ROW might have been much worst situation than now. EB3-IN will always be in disaster state. Though it is unfair to (EB3) many, this is what the law. In later part of 1990s EB categories were retrogressed for IN, CH by about 2 years. When AC21 law passed in 2000, it did two very important things. One recapture of about 216,000 EB visas and it removed country quota in each EB category if excess visas available, in that category. That means it enforced horizontal spill over. In simple example, consider Mexico which is most subscribing country. Lets assume in a fiscal year, 40,000 Mexican are eligible for EB2 visa(and no other citizens in EB2), and millions of Mexican eligible for EB3 and in family based categories, still DOS should issue 40,000 EB2 visa to Mexicans irrespective of how much demand in other categories. Because of tons of backlogs in 485 (between 2000 and 2004), particularly in EB3, DOS issued about 185000 (out of 216000) to EB3. Thats why EB3 was current between 2000 and 2004. They simply ignored the EB2 demand by India and retrogressed in 2005, though total demand for EB2 less than the available pool of recaptured visas. Since the year 2007, they realized the mistake and now (since 2007) they are following correctly (though may not fair) the law. If they follow correctly the law, EB2-IN, Ch will become current soon. Till all EB2 become current, EB3 never see any spill over. Till EB3 ROW become current, EB3 IN will not see any spill over. Till that point EB3-In will get only 2800 EB3 visas.

Thats is waht they say.. But their actions always show that they are against ALL immigration. Some of us have been looking at them for a while now. As you can see, they DO NOT support the letter campaign.
I agree with you, it does not make sense... but go figure!

See the words in RED BOLD font. They highlight you mentioning the word "REFERENCE". Kapish?!
Maybe you should check on your eyesight. And while you're at it, get your head examined as well... memory loss is an early sign of onset of senility.
Before I get my head checked, get your reading comprehension skills and life priorities checked. Searching, copy pasting others post for which you are spending too much time for too little time indicates some kind of compulsive disorder aka addiction for green card.

Congrats
I just verified the online status and the case is approved.I got approved in july-07, then applied for my wife (I got married after mine was filed). I have registered to post this message so that it might help anyone who is tracking...
Details:
PD:July-04
RD:July 24th-07
RFE:July-09 on bonafide marriage & late registration of birth
Center:NSC
This actually ends my GC journey as my 9 month old was born here.
Good luck to all who are current.
Question, though, does it really take 60 days to get the card?
Decision

Can someone explain why it seems harder to find backers in the house than in the senate for immigration reform (even the employment based legal immigration)? If we understand this, maybe it will help us focus our lobbying efforts better. Just a thought.
arihant,
The constituency of a Senator is the entire state while that of a House Rep is usually much, much smaller. So the Senator needs to make sure that all his actions are more 'Inclusive' and do not offend a lot of people.
But since the House Rep has much fewer and probably much more homogeneous set of people, the needs of his/her constituents are not that diverse and hence they can afford to take a hardline stance in many cases.

Case Status changed to Decision..with the above message today.
After 2 failed marriages (i mean with 2 different companies)...some risk-taking ..coz, i left my second employer after crossing 200 days since filing I-485 , Used EAD and took up full-time employment with an awesome organization , and then later 2nd employer revoking I-140 that lead to an RFE ...and USCIS keeping the status Response received since Jan 2009 ...and now this ...after opening an SR on 08/10..Looks like it took an exact week since the SR was created.
Of course, my roller-coaster was a small one compared to the rest of the friends in this forum.. Good luck to all and thanks to one and everyone.
Cheers..

I believe that we will get 14-15K from EB2 ROW, EB1 = 12K (currently) + 6K (Minimum), regular cap I/C 6K. Eb2 row usage is down to 60%.
Total Numbers = 14 + 18 + 6 = 38K.
Now total demand is not just 34K demand data we also have porting and new filings especially from May - Jul 2007. My assumption of porting has been 6K out of which 2K have been approved.
So really its almost an exact match till Jul - Aug 2007. We should wait for the May bulletin thing to come true firts I believe VDLRAO gave a great calculation for that.
Don't forget EB5

I have taken an infopass tomorrow to get the I-551 stamp on my passport. Once that is done I will be mailing out the form I-90 for replacement.
What is this I-551 stamp ? Is stamping that mandatory ? What kind of documents do you need while you go for this stamping ?
If one does not plan on travelling until we receive the physical Green Card - would we still have to do this stamping ?

Seems like we are so many here who are planning to file on our own. Isn't it wise to hire an attorney and negotiate a better rate, so we all can file correctly in one shot?

Hi pakrish, similar situation here. My wife's gc has the gender mentioned incorrectly. From what I've researched, we need to file for I-90 and choose option D - correction in green card. There are no fees required as it's a USCIS mistake but the original card needs to be sent with the form.
Thanks ..So do you have any idea about how long USCIS takes in this situation to complete the name change?
