Guys,
Atleast now start thinking about Citizenship. For getting the GC, there are lot of hurdles. Most of us are living in this country for more than a decade and still our status is "Alien". We are legally here paying lot of Tax, Social Security , Medicare Tax etc.,
Please go through my thread on Citizenship and start working on that. Instead of wasting our time on GC, let us make an important Agenda and express our views on the path to Citizenship, so that Congress will think about it.

I think its about time that we start brain storming the plan of action, I did like the idea of rally but that had its own Pros and Cons. We need more ideas coming from the people...
I was thinking that we could draft a letter of request to DoL and have all the members sign on it to reflect the massiveness of the issue that Management needs to know - this is becoming a major issue in the EB immigration process. We could then write up a follow-up article for newspaper or even provide a copy of that signed letter to them. Any input to this?
I have requested IV Admins to provide some input as well, but if you have any ideas please speak up!
Here is what one of the IV administrators communicated to me:
"In order for anything to be successful, it is important that we get as many people affected involved. Based on the number of people who wish to take part in solving the issue we can initiate a campaign.
Pls let everyone know that IV can help them. We need everyone affected willing to help themselves by coming out and actively participating in a campaign."
So please, dont disperse or lose hope, we need to gather more people to support the campaign, once started.
Admins: I am unable to add the files as an attachment, even after making sure that the file size is under the limit. Am I missing something?
May be we can get help from our respective congressmen/women's help on this.

Please check my previous post on this and reply from Ron Gotcher on AILA law suit. Let them do and we can also continue what we are doing. As long as we the desired result I am fine

I agree with you that we should continue the efforts from all the avenues open for us. There has been quite a lot of people that have suffered the same faith and its time we start taking some action. :)

Till early part of 2004 or latter part of 2003, most of the Indians applied EB3 very few applied EB2. After 2004, it was reverse. I doubt any one appled EB3 in 2005 0r 2006.
If EB3 stays continously in 2001 and EB2 in 2004 (there is 3 year difference in cutoff date between EB2 and EB3 now), the guys with EB3 PD 2002 and 2003 will convert to EB2 by applying new 140 to transfer PD. This flow will balance the cut-off dates. Eventually it will reach a common ground or a break-even point.

Are you sure if we can file EAD between 120 and 90 days prior to current EAD expiry date?

can you please tell me the source of these stats? Per the DOL stats, from March 2005 to March 2007 only 130K total cases were approved:

Those are not Labor approvals, those are Green Card approvals.

The speed in which h1 FOR MS in USA shows that there is not that much demand to H1s. Only around 7500 was filled. The H1 Cap 65000 was reached for because Indian companies were rushing to make it before H1 cap is reached. One has to analyse how much is going to be used really. They will use need basis and won't cancel if not used. So increasing to 110k will be enough to meet the real demand but then also Cap will be reached in another 2 months because consulting companies process h1 first and find the job for them later. But Real demand can be analysed in other way. Because of Rushing thro H1s lot of companies which are having Real job demand(Companies like Intel Microsoft) could not hire. H1s for US MS degree holders solved the issue Partialy. May be if the increase that quota to 40k then demand will be enough.

I never saw anything like this it is far worse than the government municipality office. There is only one lady at the counter nearly 200 people waiting. She is doing things at her own pace. They were fighting over missing $10s, nepotism etc,is prevailing, they have an official line and an unofficial line. It looks like a shack than a consulate. Burger shack is better than India Consulate. After more than a month I am still waiting for my PP.
I went to the DC embassy to submit my passport on December 9th. The line was long and the lady was efficient. the only problem is if you don't have any of the docs, you are out...need to come back again..and the DC website is the worst of all...does not give all the documents required. I had all of mine and was done in an hours time. I was asked to come back on Jan 29th thats a month and a half later.
I come back and the place is like a movie ticket counter for the first day first show..no queue..not organized...people just walk in the front of the counter and gather even though they see a line..also the lady at the counter was RUDE...throws the passport right at you...there was favoritism to the department of state guys who came seeking visas!

I have a question regarding an appeal I did a year ago for a rejected LC.
I have an approved LC and I-140 on an entry level position (EB3) with my company. after I got a promotion to a senior position that requires a masters degree but with a smilar job description but more senior and supervisory responsabilities with the same company. after promotion, I filed for a new LC (EB2) but it got rejected because DOL thinks it is the same position as the already approved LC. my company and I wrote a letter as an appeal on Sep 2006 within 30 days from rejection of LC to BALCA explaining that new position requires a masters degree and it is a senior position with more supervisory duties. as of today, almost a year later, we haven't heard anything regarding DOL (BALCA) decision on my appeal. is anybody in the same situation?? what should I do next?? also I read somewhere that DOl might revoke the already approved LC EB3 after I filed a second LC for EB2 with the same employer. can DOL revoke the first LC EB3 after I have an approved I-140?? please help. He meant that 140k Visa numbers allocated each year, out of which less number Visas are actually processed by CIS, all the unused visa numbers in the past which might be more than 300k should be used now to reduce the backlog.

CIS did not issue all those 140K visas for past sevaral years despite of the fact that there were more than 140K applications pending with them during all those years. Those visa numbers were lost and the applications accumulated over the period of time due to inefficient USCIS process.
This is what ombudsman said about this issue and I quote
"For example, when employment-based visas are not used during the year they are authorized, they are lost and are not available for future use without special legislation. In FY 06, over 10,000 employment-based visas were lost, even though USCIS had an estimated 100,000 to 150,000 pending applications for employment-based green cards.36 Based on USCIS use of visa numbers as of May 2007, at present consumption rates approximately 40,000 visas will be lost in FY 07 without a dramatic increase in USCIS requests of visa numbers.37 As illustrated below, since 1994 there have been over 218,000 un-recaptured employment-based visas lost due to underutilization of the employment-based visas. " end quote.

We need about 1000 members signing up for the monthly contributions in a month. I am sure we can do that. We have 8000 members and it should be easy. Till now we have only 100 signups
