March I applied H4 for my wife. It's still pending. She is travelling to India next month and will be back only Feb. Currently she is having valid AP till next yr and we are planning to use AP this time. If you are applying H4 not along with H1 then it'll take longer time, but you can get H4 stamping in India with your husband�s valid H1 document. You don't need to have H4 document for your stamping. One of my friend�s wife similar to your situation got stamping in India without H4 document.

Based on these reasons:
1. EB legals doesn't really count when it comes to the consideration. For one, the numbers that are suffering are too small; for two, what you go through is nothing in the eye of Kennedy's --- you have a job, you have enough food, you are not dying in the desert....you are having a pretty decent life, except that you wanted more;
2. Senators like Sessions can still argue that "so many legal people are waiting in the line", because you are indeed still waiting even though you can now file 485. So allow you to file doesn't really change their argument;
3. What makes you think that if you shut up they are going to have a easy day? It's not like that you have any teeth to bite any way.
So the PD moves forward is definitely a good thing regardless how CIR plays out.
Mark my words.... President Bush will single handedly make sure to pass the bill as it is.....
No one can stop it.
Do you all think it is just a co incidense that all the dates became current just when this bill (which was supposed to be in grave :rolleyes: ) is revived by those who extremely opposed it?
Do you know how many people will stop giving a damn, because they just filed their 485 s?
People like me who are result of bad practice employers are still here, and lucky ones will depart.....

I am sure this what might have happened since you talked about FP.
Did you and your attorney both receive the FP notices ? I think one of those copies was returned to USCIS as undeliverable. What they do is they wil check the system for any address change and then put the returend FP notices alogn with the envelope in a new envelope and mail it out again. We had this weird status for few people duingthe Jul 07 rush and that was what it was. Let us know if this is the case..

IMO: 7th Year extn can be filed if PERM is pending for more than 365 days or if I-140 is approved.

Process has been initiated by employer and tentatively labor will be filed in June, 2011. Hoping that he will be done with labor or I-140 by November would he be eligible for 7th year H1 extension?

I forgot to mention one thing..my h1 was done by an university ...in 2002 when this quota was not there....just because its done by an university..I cannot assume it came under a non quota-exempt...since this was done when the quota system was not in existence...

The bill also states that USCIS has consistently failed to reduce application backlogs and has suffered from a lack of transparency and effective management.
�Our immigration services need to move into the 21st century,� stated Rep. While I agree that USCIS needs to modernize its existing infrastructure and procedures, they must do so in a transparent and open manner. How long ago was this approval done and from which service center ?
Also do you remember how long it took for the receipt notice ? I hear for PP services one also get a receipt thro' e-mail if provided by the attorney.

I was on regular H1B for three years until mid 2008 when I changed to H4 status. Now, if I want to work for a non-profit organization, does the org have to just transfer the original H1B or file a new non-profit petition. If it is the latter (new petition) what happens to my original H1 approval? If I want to go back to the for-profit world do I need to apply for a new H1 or will my original H1 validity continue??
