One of my friend was in a similar situtation.His attorney filed h1 extension providng the proof that a previous labor application was denied and the new one has been filed and is pending . He was able to get his h1 extended for an year.His situation was far worse , he had only a month left on his h1.

Yes, this is very sad. I did receive the same email. Monthly $10 wouldn't be much. May be you can get rid of one pay channel or the munchies from grocery store. That's the only sacrifice you had to do !

I got EAD with "finger print not available" on card. Strangely ,Online status doesn't has any information it still displays that NSA received my EAD application and they are processing.It seems they are sending EADs but they are too busy to update their system.

Asking for not revoking I140 would be helpful. Also make sure that you at least have copies of the I140 approval notice and I485 receipt notices.
Copies of your Perm labor certification would also be helpful as you may need to consult them for looking at the job responsibilities used for your original labor.

Hi,
I applied for EAD Renewal on DEC-18 2009 ( posted to Nebraska Service Center)
It has been a month I havent received any Receipt or RFE and check for fee has not been cashed
My EAD will expire on March-15th-2010
What to do in this sitiuation?
Is there any customere service No to reach ?
Do i need to reapply ? Did anybody encounter similar situation. If so please let me know what you have done

It's time for USCIS to implement the regulation. I suggest we as IV members or individuals, sent fax or mail to USCIS Director. Hopefully things will change and if not we do not loose.

yeah mike ,
you should use Swift 3D for the initial 3D rendering and animation . its also good to import that animation and any other animations to Flash itself. oh yeah and also you can customize how many times you wish for the animation to loop.

She can file her own extension using form I-539. You can use your receipt number in her application. I am planning to do the same. It doesnt make sense to pay the lawyer a grand for that. If your H1 is approved, her H4 will be approved. There is no way I can think of having your H1 approved and her H4 being denied unless she has any violations or out of status etc.

thanks for your response. My lawyer said she mailed with Fedex and it was delivered 3 weeks back. She is saying these days it takes 3-4 weeks to get receipt notice. but I am not sure whether its true or its just my case getting lost somewhere.

Hi Sri,
Don't panic. This is NOT the end of your immigration journey. You are covered by AC-21, so if you find a job in a similar occupation with another employer, you can certainly take it. Your employer should seriously consider appealing the denial in order to preserve its reputation and to continue to employ H-1 workers.
If you have reason to believe that your employer might not be fully compliant with immigration laws, particularly as they relate to labor certifications and I-140's, you would be most protected if you changed employers

I am planning to get my H1 stamped during my next trip to India and have a couple of questions
1) Have anyone used Yourmaninindia or Sahara Care or any other service to deposit H1 forms at VFS Mumbai. For Mumbai consulate, the forms need to be submitted 3 days prior to Visa Interview and they do not accept courier :mad:
2) I recently found that if you have an appointment at one of the consulates in Mexico, you can Fax the 797 and get PMIS verified in advance.
Do we need to submit the entire H1 fee for appointment ? If there is a cheaper way, I am thinking of taking an appointment , get PMIS verified and cancel the appointment.
3) Any idea if they do a PMIS verification for H1 extensions (same company) as well ?
I am hoping this helps. My H1 renewal 7th year came through in December effective January 10 2010. I was at the Mumbai consulate interviewing for H1 visa on January 21st and received my passport in hand in 3 business days.

My parents are going back to India in April'10 just before completion of their 6 months. But they want to come back again after 3 weeks. They have got their visa for 1 year. So they can stay another 4 months on their 2nd trip from May'10 to Aug'10.
Is it going to be a problem during their next visa stamping or immigration at airport as they will end up staying 10 months in US out of their 1 year approved visa ?
Please advise.

Why is Gary looking outside of USA to tap potential home buyers? Just for folks who aren't aware - there are 500,000 high skilled legal immigrant already in USA who are waiting in queue for numbers of years to get their Permanent Residency. Thanks to the limited visa availability based on country chargeability (birth of applicant) and inefficiency of immigration system, these highly skilled, tax paying and law abiding immgrants are waiting for their Green Card (Permanent residency). Some of them have studied here, worked here for years and US is almost a second home to them. They are sitting on pile of cash, Yes - PILE OF HARD CASH. They wouldn't buy house or any big ticket items until they get Green card. Why not give these people, who are already part of our system, conditional Permanent Residency who buy houses. Some where I read that there is no fee for renewal of AP. I am a Jul 07 filer and am not sure about this. Further already applied last for Advance parole and travelled till it got expired last month. I am applying for a new one again. So just wanted to know if I need to pay the fees $305.
So my questions are:
Does the July 07 filers need to send the cheque for $305
Should we also include Biometric fee of $80?
And how much time is it taking these days for AP/

There is a confusion regarding who pays what amount.
To avoid the filing date confusion, stick to this simple rule :
If you paid less than $400 ( I do not remeber the exact I-485 fees prior to the increase), then you need to pay for the Ap and EAD, the respective amount. If you paid more than $900 for your I-485 filing, then go file AP and EAD as much as you want.
For either case, you do not have to pay for the biometric. Biometric is only for EAD. Not for AP.
AP takes roughly 45 days.
Hope this is clear.
