    The AILA memo says this:

    Of course not.

    AILA is trying to establish a precedent by saying that only the VB is the one that should determine the visa availabulity.

    Are you saying all EB-2,3 will remain current until July 31, 07?

    You should call NVC and check with them the status of your application, most likely they have done all the processing for you. I doubt that they have a visa number for you, if they did they would have called you for an interview already.

    Sorry, should have said that the NVC had visa numbers for us - last year. Of course we won't hear anything from them until our PD becomes current.
    But thanks for the tip to simply call the NVC and inquire about the status of our application, until now we only called the automated system and sent inquiries by email. Talking personally to someone might give some more information than the automated response :"Numbers are not yet available."
    I'll keep you posted ! And good luck to us all in the future ! :)

    Smisachu,
    Thank you. We appear to have similar filing profiles. If your profile pic is of yourself, we probably have similar interests as well, although I ride a standard, not a crotch-rocket. :cool:

    Have you considered the fatc that if CIS is going as per Receipt Dates within a PD batch, we're talking thousands of cases?

    Yes our profiles are very similar what with employer close out on our first applications:(

    And yes I am very much a crotch rocket/rice burner Yamaha guy.

    Let us wait for some more approvals and observe if the ND theory holds water.

    This rumor from fragomen's site is creating a havoc everywhere.

    These rumors are wreaking havoc on people who are not in a perfect position to control the timing of filing. Many lawyers and many employers will file between 25th and 31st July. And I can accept that. My own HR and lawfirm have made it clear that we will file before 31st July but there is no guarantee that it will be sooner than that and any sooner than that is not neccesary.

    Those who are filing on their own can file on July 1st. But those who are depending on lawyers and their own HR, please relax and stop thinking too much.

     Filing Fees: $1450.00 ($315 x2) + ($165 x 2) + ($175 x 2) + ($70 x 2); for two petitioners (indianabacklog - reported these fees are outdated. Please check these fees with USCIS website)
     Form G-28, Notice of Entry; (for each petition (I-485, I-765 & I-131) and for each petitioner
     Form 1-485, Application for Permanent Residence, with two (2) photographs attached and picture I.D.;
     Form 1-13 1, Application for Travel Document, with two (2) photographs and picture I.D.;
     Form 1-765, Application for Employment Authorization, with two (2) photographs and picture ID.;
     Copies of Form 1-94 and H-lB visa stamp;
     Copy of Form 1-797 Approval Notice for H-lB Petition;
     Copy of Form 1-797 Approval Notice for 1-140 Petition;
     Copy of passport;
     Copy of long form birth certificate;
     Copy of marriage certificate;
     Form 1-693, Medical Examination Results (sealed); (In medical examination go for chest X-ray instead of skin test).
     Form G-325, Biographic Information.

    Try to read all the forms before you signed and send to attorney. Due to heavy work more chances to mess up the information from attorney side. Try to download all these forms from USCIS (some of these are fill able with save option) and try to fill as much as you can, at least your personal details, residency history in US etc and compare with your attorney documents when they sent for your signature.

    Best of luck guys who all are eligible to file their I-485 after long waiting time.
    What is this picture I.D.? My wife is on H4 the only I.D. she has is passport ( NO DL). What else can we submit for photo id?

    It looks like to me that Porters strike again. they have eaten all the Visa's. very few approvals so far. I am worried about next bulletin now. dates can go back now. every EB3 is porting to EB2.

    we see the results. they will block EB2 too.

    once USCIS gets a visa number from DOS for a "pre-adjudicated" app, it has to complete the approval and assign the visa number within 7 days, if not the visa number has to be returned back to DOS.
    In this case they requested too prematurely.

    to put numbers to your guess, I am guessing roughly even at an optimistic approach, 1000 applications from EB3-I from 2002 may have ported to eb2 or left the country and nothing more than. Why not we do these guys. just a IV sampling poll. Lets create a poll for IV members alone, for eb3-I alone. Lets give all the 12 months as option, and people can update. We can atleast know how many cases are waiting in eb3-I from IV alone for the year 2002. What say you guys? any one wants to take up the initiative? We can also Add an option additionally for 2003 cases and so forth as one option. Our goal is to find how many of us here in IV are waiting with 2002 PD for eb3-I.

    Why did they waste 500 EB3I last year. What makes them approve EB3 at that slow rate. All the cases are at NSC for 10 years. Why the ##&( they are issuing 1 year EAD for EB3I. There is no FIFA or whatever it is. How can TSC approve all cases at such a fast rate and NSC sits on them till the processing time is crossed and wait for a SR .

    Car Loans and Home loans are called secure loans. If you do not pay the monthly premium, they have the right to get the car or home from you. So, a person, leaving behind a car/home and going back to home country is not doing anything criminal. He is playing by the rule. Of course, these acts would shine on his/her credit report for a while.

    Credit card loans are not secure. That is why, car loans APR vary between 0% to 5% but credit card loan can go up to 33% if not higher. Basic nature of credit card loan is, it is a very high risk loan and there is no collateral against that loan.

    God help EB3I

    I am not offending any one and that is not even my intention.

    God already helped us with good jobs. EB3 I waiting numbers are around 60,000. I am sure at least 20,000 of them are either IV members or silent members. If half of 20K contribute just $100 (Hundred) dollars, that will be a million dollar kitty which will make HUGE impact during lame duck session. Any takers? But every one has to contribute.

    God will not come to our rescue when we can help ourselves.

    I think TSC might wait until August 1st. Because if they send before August 1st they might end up giving 2 year EAD. So it might be trick. But i don't care whether they issue 1 year or 2 year EAD. As long as they issue EAD before it expires i am okay. Let's see tomorrow.

    I dont care about the years for which EAD will be issued. I just want EAD, so that i can keep on working. People who got their EAD fast, should be happy and relieved, atleast they dont have to go through the ordeal of waiting every single day. I hope TSC awakens soon and starts approving EAD's.

    GO IV GO

    I personally do NOT think that giving DV numbers to EB will make any difference to EB3, because once EB2 is cleared up there wil be more EB2 people out there to consume visas and there will be no spillover.

    Having said that if this bill goes through then it will most certainly give GC to EB2 people even those who have a priority date of 2011 and also to people in India who are planning to come to USA in thee next few years or so and who know enough of US immigration to know that they have to file for GC in EB2 category

    I will not even raise the point about providing a part of the 50 k visas specifically to EB3I because lets face it EB2 are the elite and deserve to have priority in visa allocation.

    Facts: As of 2007 there are 54,850 application pending in EB3 india category and as of 2007 there are 13,150 application pending in EB2 india category
