Dear sir/Madam;
I have worked in my organization for over one year in the US and abrod in the subsidiary for one year. My organization is trying to apply for L-1A (managerial category) visa for me to come back to US again.
How easy is to obtain L-1A through immigration lawyers?
What forms do I need to submit for applying this visa
Our company attorney does not provide complete information, therefore I would appreciate your help on the above.

Isn't it the employer's responsibilty to file new LCA when I was assigned to another project in another state?
If my employer has not done that for me, then does it still affect my chances of getting my H1 stamped. Means I am not at fault, my employer is.

1 - YES
2 - H1 & L1 VISA timming duration are counted together for H1B period. I have already went thru this cycle.
3 - Advise to stay on L1A, apply green card and switch to H1B as soon as you are eligible for H1B extention beyond 6 year.

I applied on Jun6th and got my EAD 2 weeks back. I took infopass to expedite the process. The IO wrote an email to someone in TSC. I got approved next week. Give a try taking Infopass.

The NC DMV is taking a really long time to validate my EAD. Its been over 60 days now since my license renewal based on EAD expiring October 2010. They keep sending me back with a temporary license valid for 15 days saying they are yet to validate and issue my perm license based on EAD.

I am in the same state as your's. After talking with Lawyer and after reading lot of forums, i went ahead and submitted with PAR:PAROLEE for both Manner of Last Entry and Current Immigration status.
I am not lawyer :) but that's waht i went with and submitted just yesterday

If you ask them to expedite then you are talking to a wall..which means that is next to impossible. I requested them to expedite my EAD renewal twice and they refused to do so (email reply). My case is 78 days old now and the current EAD is expiring in a month from now.

United States Citizenship and Immigration Services (USCIS) has updated its periodic count of FY2010 H-1B cap (http://www.h1b.biz/lawyer-attorney-1137085.html) filings, revealing that there has been a significant increase in the rate of filings during the month of October 2009. USCIS has stated that it has received a sufficient number of petitions to use all of the available 20,000 H-1B numbers that are reserved for individuals with advanced degrees from U.S. colleges or universities, which means that the "advanced degree" H-1B cap for FY2010 has been reached. H-1Bs for individuals with advanced degrees from U.S. colleges or universities can still be filed, but those petitions will now count toward the general H-1B cap of 65,000.
Around 6,200 cap-subject H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) petitions were filed in October 2009. This is a significant number, especially when compared to the only 1,500 filings received by USCIS in September 2009. In total, as of October 25, 2009, approximately 52,800 H-1B petitions that count against the congressionally-mandated 65,000 limit have been received by USCIS. This leaves only around 12,000 H-1B cap numbers for FY2010, without taking into account the 6,800 H-1B cap numbers that are reserved for nationals of Chile and Singapore. If all 6,800 of these "reserved" numbers are removed from the 65,000 cap along with the 52,800 H-1B cap petitions already received, there are only around 5,400 FY2010 H-1B cap numbers remaining.
As a practical matter, USCIS will likely accept well more than 5,400 additional cap cases in FY2010, as the number of cases USCIS will accept anticipates that a certain number of filings will be withdrawn or denied. Additionally, nowhere near the full 6,800 Chile/Singapore numbers have historically been actually used by nationals of Chile or Singapore. Thus, most of those numbers are applied by USCIS to the general 65,000 cap.
While USCIS is still accepting H-1B petitions for FY 2010, the recent jump in filing means that by mid December or so we will have no Visas left. My advice go ahead and file now.

There is a quirk in the immigration laws that allows a person working for a cap-exempt employer to start working for a cap-subject employer once the petition is filed, even if the new H-1B status cannot start until 10/1/09. If the new employer files an LCA with a start date of 7/27, you should be able to work for that new employer under H-1B portability. However, if the new petition is denied, you lose your work authorization immediately.

Hi guys, I have a unique situation, thanks to july visa bulletin. I have a EB3 labor and I 140 approved with the PD as May 2004. Recently I applied EB2 PERM in order to port the PD from EB3 to EB2. My EB2 perm is approved now. Now, I am in dilemma to choose between EB2 and EB3. I can apply EB2 I 140 and I 485 concurrently (by assuming that they will port the PD) or I can apply I485 (for previously approved EB3). Please suggest as to what route I should take.
