I support your view. Let this punjabi guy go into foreclosure and screw up his credit history and suffer for the next 7 to 14 years. Its not just him, his entire family will suffer because of this.
Those who oppose the foreclosure, i think you guys are indirectly helping this punjabi guy. He has good job, good salary and he is capable of paying his monthly mortgage and he and his family are sleeping without any issue right now. If he is not going into foreclosure then how do you think this guy will suffer for the next 7 to 14 years?

Even i own a house and i don't live there because of my job situation. I have rented out my house. I live 700 miles away from my own house. My house value has dropped and i owe more than the house value. But i have job and i am capable of making my payments. Do you think i am eligible to go for foreclosure? Not really.
Note: I know a friend who lost his job back in 2001 and couldn't pay his car loan(he could've paid). It was about $5000 and it ultimately screwed up his credit history. He got into a good paying job after a year and he wanted to buy a house back in 2002-2003 period. He was not able to get any loan including credit cards. His friend had to co-sign for him to get into an apartment. He is still repenting his decision of not paying off that loan. Recently he got a car loan at the rate of 12%.

Do we need the Birth Certificate for secondary applicants(spouse).
None of the checklist(Employer based I-485) I have been thru say that I need the secondary applicants Birth certificate.
My spouses Birth certificate is in a regional language, and hence the question.

There is popular agreement among the folks that filing multiple I-485 is fine (if one sees a need) but file only one set of EAD/AP. My concern here is relating to which I-485 to choose for filing EAD/AP. Wisdom says choose the one with I-140 that is approved or whichever has greater possibility of approval. Say, I have both I-140's Pending and file EAD/AP with one of them. In case this 140 gets denied what is the fate of EAD/AP that is Approved. Will these become obsolete even if the status of applicant is AoS as a result of other 485?
If the second 140(**) gets Approved before the 140(*) on which EAD/AP is currently filed/Approved, can I renew/Start filing EAD/AP on the approved 140(**)

Today only I realized that I filed G325 instead of G325A. I am still not in teh system. But I am v depressed. Any one aware of similar case and what is the possibilities?
i dont think thats an issue veerufs . there are some who did in past and idont think thats enough for return but not sure what other expenses dont get depressed.

The competitive angle did occur to me. There is no reason a business should not look for ways to cut costs. However, this is a question of fairness & legitimacy. A L1 visa person living in a low cost country and coming here temporarily on short-term assignments can make do with lower wages because he likely does not have to support a family here at the US cost of living, and L1 spouses can work. This is not fair to a H1 with same skills whose H4 spouse cannot work, and for the same reasons it is not fair to USC/GC folks. Isn't that why we currently have all this labor certification processes and DOL laws? Those laws are designed to level the playing field. It is not easy for the company to outsource entirely, so they break the law by abusing the visa. Why should we not act to stop this illegitimate corporate action?
If that does not sound reasonable, let me ask you this: Why should USCIS and law-makers even consider taking steps to address green-card backlogs, adding resources to process more cases more quickly when they can just sit there and collect fees from you for visa / EAD renewals?

Thats the right way. Probably I should not have told him that I have AP in my hands. This is what my attorney said. But now I have no idea if my h1 will be extended or not once I have used the AP.
If you really want to be on h1(very safe decision), why don't you leave for a couple of days and re-enter on your H1?

EB3 has a significant drop, Most of ROw applicants are filing in EB2 these days thus offsetting any significant advantage in filing EB2. EB3 will be faster comapred to EB2 some time between 2014-2015, EB3 still gets 40000 of quota.

Even USCIS has pre adjudicated all AOS cases , DOS will not be in good shape to predict perfect cutoff date ever. WHY ?? Every year in Sep DOS move dates forward in order to prevent visa waste. Lets say because of these pre adjudicated DOS knows that they are 10k pending app before Sep 2004 and supply is 7k. Still they will move date till 2004 Oct just to give room to USCIS. If they move date to July 2004 which has 7k app and supply is also 7k and some how USCIS has problem approving some cases because of some reason then they will waste few visas.

In Oct they moved date forward little bit because DOS think USCIS will not be ready with those left over case from 2004. Thanks ... normal options in USCIS asks you to call ICE.gov ... BUT ICE.gov doesn't seem to have a local office.. please let me know if anyone out there has gone this route and any update regarding what all documents we need to produce to prove our case. Since its a Billion dollar company they are bound to fight the case (hopefully). Any information regarding the same is appretiate.

I am very sorry to hear this. It should be a rare case that you have got 221g after your visa has been approved by visa officer.
Approach the consulate with your email, and they might give you a questionnaire to fill up. It must be regarding some additional documents being required.

How can you get approved when your PD is March 10 2006 and as per August bulletein you are not current and Sep bulletin comes in to Effect only from Sep1st?

USCIS website update says NSC are working with August 13th 2007 received AOS applications. USCIS is not following the First in First out (FIFO) process for sure. Why August received application are getting Receipt Notice and subsequent benefits (EAD, AP, etc) at the expense of July 2nd filed application? It’s unfair to applicant like me.

EB3 will not any visa from recapture bcoz it will go to EB2 first. EB2 line is not going to clear in next 10 years bcoz nowadays everybody applies in EB2 and as they move VB forward for EB2, more and more people apply for AOS and it never ends.
So EB3 won't be benefited by recapture unless there is a clause specifically for EB3 allotment out of that recapture
We need some numbers to back this up. I think you are saying EB2 will not become current even with the recaptured number. There is another thread for requesting numbers from USCIS about pending applications per category, per country. So, participate in that campaign as well.

Is the end of the three year period considered when you applied for LC, or when you apply for 485/140? Since, technically, people who are pending at the BEC as well as those who are affected by retrogression are still on NIV, and have not applied for immigrant Visa yet.
This point will have an impact on a lot of folks who may have applied for LC less than three years after getting their Degree but would have crossed that limit by the time they can apply for the immigrant Visa.

I called FBI yesterday and asked for FP results. I was told they sent it to uscis and I saw LUD. Question is:
1) Does finger-printing & name check go together?
2) When FBI sends it to uscis does it mean nc/fp cleared?.
Any thoughts on this?

Just wanted to mention here that i got an email from my attorney's paralegal that they got receipt notices on friday and will let me know about them soon.
As of now i do not have any idea the receipts are from which centre.
