AP is sent to the lawyer if you filed the G328
Not always true, I've filed G-28 in my case, but received the AP at my residence address. Have friends/colleagues who had received AP at the attorney address. So it is kinda random. No logic behind this.
It is important we get the document.

...We are even more screwed because since our dates are current we can not even get 2 Yr EAD or 3 yr H1 extension but you have to renew both annually....
That is not true. In my case, when I sent my EAD renewal my PD was Current. They sent me a 2 yrs EAD instead of processing my GC. So weird.

I may have lost it there for a bit, I agree. Obviously you are obsessed with me to the point of ignoring my main points and attacking me for the minor ones. If you read the thread, iskantem and I continued our conversation after that.
My points again :
1. The diversity argument is flawed when it comes to skilled immigration, especially when we have most of the grad schools here filled with Indian/Chinese students. This is what I was explaining to "iskantem" and why especially when you are talking about less than 0.05% of the population it doesn't make sense.
2. We don't even allow anyone over here to have an alternate opinion on an issue. In terms of IV activity, it is almost 100% Indian. However 60% of the EB3 backlog is not from India! Now why don't we see these 70000+ ROW guys participating here I wonder! Let me tell you why. Its because a lot of us actively discourage them from participating whenever they have an opinion contrary to ours (read India). Now I maybe guilty of losing it a little there, but I still made an effort to reach out and explain the flaw in the diversity issue he was mentioning rather than mount an all out attack/ignore him right away/stick my head in the ground.
Well, of course since you are so obsessed with me and also with getting reds (if you notice I didn't give you any) you may have missed them. Happy that you got me? And happy you didn't get reds? Good, enjoy your day. Please let's get back to the issues now. Peace.

There is no doubt the policies are flawed, foolish or whatever. But I maintain that screaming out to another person/s in a forum is of little good. Agreed that your arguments have weight, but they should be made to the right person at the right time. So let's wait for the next letter-writing event and we can participate in writing the draft..

To serve legal notice is meaningless unless he has filed a complaint in court in which case he will likely have to pay a $100 to $200 for an "index number", and then pay a few hundred for an official process server to personally serve you or only if you cannot be personally contacted do "nail and mail". That is the procedure in NY state, because I've been the plaintiff against visa sponsor (I drove him to brink of bankruptcy before I dropped the case). For $3500 it would probably be small claims court, but the procedure will be roughly the same.
Forget about the idea of him "creating documents", what are you suggesting that he forge your signature. I doubt that he has the balls to do that, because to present documents like that in court is a very serious offense. He would be putting everything he has on the line for what -- $3500 minus expenses because you cannot claim expenses in small claims court.
Sending you an email is laughable and just shows that he is either not serious or ignorant, and likely engaging in scare tactics.
I stand by my prior advice, go see local IRS customer service center. The worst that will happen is they help you to start off the official written complaint against him, and they explain what to do in absence of W2. The best that will happen is that if you explain the blackmail a customer service person will call him on your behalf and put the fear of IRS into him. I would expect that there is a high correlation between employee abuse and tax abuse, so IRS may be interested to know who the bad apples are.
Recreating records for W2 is just a few hours work if you have pay stubs and bank records. I know someone who has to do it every year. Actually I'll email him a link to this thread. He won't be able to reply for a week because he is off for a week training.

Here is another part of story.
My PD was current back in 2004, this attorney/employer ignored my calls/emails from Oct to Dec 15. They filed my 485 during christmas week end, they screwed up something and USCIS rejected my application (thats what they say). Thanks to retrogession from Jan 2005. All my documents were ready by Oct. I would have had my EAD since 2005.
De javu, again I am being mandated to file thru same attorney. I don't have problem paying more money for a good attorney and good service.
I don't know if I am in a trap or something.
I think u r in a trap here. I recently talked to a HR of a desi company and he clearly told me his boss does not want to file for 485 for all eligible applicants and is working on strategies to fool his employees into prolonging things till dates retrogress.
U can choose ur lawyer, u don't have to let employer know u applying for 485 at all. Do not link ur lawyer and employer for any reason. Keep them both away. U already have 140 approved and u have nothing to lose.

So this confirms FIRMLY that antis and BusinessWeek are working in tandem against legal immigration reform. Sometime back.. I read that BusinessWeek is for sale.. by McGraw Hill (its parent company). I wish.. that sale happens soon and let common sense prevail. Probably they are trying too hard to shore up their subscriber base by evoking the last resort.. creating sensation with meaningless issues.
If the sale takes place, it probably will be bought by either a Chinese or Indian company. Some dumb anti-immigrationists will try to block legal migration every possible way when most of their companies are either taking jobs overseas or getting sold to foreign companies. Go and find the source of what has destroyed the economy and try to fix it. No foreigner has ruined the economy.

EB2 I should get more spill over from EB2 ROW that what it got last year. The number of labor approvals is very less after June 2008( someone posted it earlier in some other thread). EB2 ROW is always current and I think the usage should be low this year.

O.K. I know it's not the place for this discussion as we need to be optimistic and strong, instead of jumping the ship....
However, after years of wait (which perhaps was not that long compared to many others) and after sobber look at how much longer this may take I start to wonder if it worth it? I am starting to take what used to be a plan B - moving to Canada - more seriously now.

Was this is a change in the procedures of USCIS? If yes, could we not request them to increase the length of the EAD from 1 to 5 years? This will help many of us too. I need to get my DL renewed every year along with the EAD.

I m surprised why this was not discussed with USCIS. Quarterly spill over reduces the waiting time, and also ensures a fair way of doing spillover. If the rules state it should be practiced and it has not been done till now it is something that IV can easily convince USCIS to practice quarterly spillover with its contacts.EB2 I will remain same

Attorney fees for the spouse thru husband's company -> $800
Attorney fees for the spouse through my company -> $3500
