Goldie, the Baby Golden EagleI am not getting paid equivalent to what is there in my LC. Is there any problem to get approval of my I-458?The I-485 has nothing to do with your salary, it is the "Application to Register Permanent Residence or Adjust Status". It makes a difference for your I-140 application, though, but you will need to re-phrase your question then.

and a Golden eagle.Both my husband and I have been using our AP for traveling for the last few years and he uses his EAD for his job. So trying to say that we don't use our H visas but his employers renew them anyway when its time to renew.
Our H visas are about to expire this week and the lawyers sent in the extension paperwork to INS in December. Somehow we never really followed up and recently realized that somehow my husband's H1 application either never reached there or got misplaced since they only sent my H4 receipt even though both were fedexed in the same envelope. His employers are going to file again.
Now we are planning to travel next month. So here are my questions:
1. Can we travel with our applications pending?
2. If INS considers our applications abandoned if we travel, does it make a difference, especially because we don't use our H status for either work or travel?
3. The lawyers are suggesting expedited/premium processing for my husband. How long does it tae these days (Vermont center) and can my H4 be filed along too even though one is pending since December (and I think it will remain pending forever because it has no corresponding H1 so how will they approve the H4)?

I'll have a go at cloning out the twigs later, it looks a bit difficult but it could be fun trying.Cloning sometimes leaves weird patterns. I've had luck putting a loose selection around the cloned area with a big feathered edge, then applying a gaussian blur. It helps "clean up" my new background. The trick is to have a seemless blend between the cloned and the original untouched areas.

More realistic is the situation when illegal will get amnesty and legals may be put ahead of line.
Also the window may be as little as 30 days like in July 2007 as long as anytime (say someone with PD 2003 in EB2 --any time in the future)

aby golden eagle pictures.The short answer is yes. Once you have an approved I-140, you can ask to be accorded the PD on any subsequent I-140.

Mine is not a Lobour substitution. In fact I am in L1A and mine has been filed in EB3 category. It is done by PERM and it has been approved. My designation is Program Manager and based on that the Labour was filed. My company is doing well and also pays well.
Please advice if that would help.

golden eagle with transmitterMy attorney is encouraging me to take part in the proposed AILF Class Action Lawsuit against the Government by submitting I-485 to USCIS knowing that its going to be rejected. Anyone decided on this? What are the pros and cons? If there is a favorable outcome, I-485 may be accepted at that time (months? / years?). But here is my big concern: if I am a part of that lawsuit, my 485 may be considerably delayed (my PD is Feb 2005) ! I am aware that IV is encouraging lawsuit too. Any comments?

I am looking to switch employers. Although the job descriptions are pretty similar ( C coding, design, protocols etc.), my PERM was filed for Computer Software Engineer-Applications whereas the new one falls under Computer Software Engineer, Systems Software. Is this a risk during I-485 adjudication. Also my new salary is 50% higher than my original PERM salary (It has been almost 4 years since my original PERM).

Does anyone have experience with expedited H1-B filing? The one that you are supposed to receive the answer in 15 days. I am just wondering if it really works and if it is possible to hurt your petition by filing expedited?
