But, no receipt for me yet. July 2nd filer here as well.
Should I keep another set of 485 application ready, just in case if I don't hear about check cashing or receipt till august 15th ?

Do you happen to know who used your labor certification? If you have a copy of the LC and I-140, inform the DOL /USCIS that someone has used your LC and I-140 without your knowledge. I'd like to believe that USCIS will take note of this and will deny the application of the person who used your LC and I-140. Your employer will be in deep trouble because of what he has done. USCIS may investigate the case. It will be wise not to mention that you paid anything. The fact that you were hired under H1 status and is still working with him shows that the LC and the I-140 rightly belongs to you.

If you have good documentation of this... then there are some fees that employers are not allowed to pass on to employee (either in part or in whole).
These include things like H1B processing fees.
They might include labor certification fees (required for GC).
Now unless the 50% specifically identifies which fees, I would take it to mean 50% of all. If your were charged for 50% of something that it is illegal to charge for then Department of Labor may pursue both on your behalf and in the public interest. By pursue, I mean get your money back (or some of it) and fine or worse to employer.
So find out what documents you have and where your local dept of labor is, and go and pay the friendly staff a visit.
I know someone that was done out of a few thousand in unpaid overtime. They got his money back for him, even though he only went to them years after, but he had pay slips showing hours worked and money paid. They handled it all for him.

These are things beyond our control. Best not to get anyone's panties into a bunch over such news. If the GC is not possible, that is still OK. Move back to the country of origin and life will go on - thoug not as planned.

With a comment "ooooo". I want the IV admin's to find out who that coward is and ban them from any and every board that is out there on internet. So do you mean to say that this is allowed in India? I mean polygamy. I never knew that.
Muslims (around 20% minority) have this special law accepted by indian democratic government. In fact persons from muslim community can marry upto 4 wives at a time. However I haven't seen this as a common practice. Not sure if that law is changed recently. I guess No other religion is allowed to do so in india. I remember reading some cases in newspaper where people from different religion have converted just to legally marry more than one persons in india.

Look, everybody interprets and sees the way they like and the way they want. Like I only chose to respond to the red dot issue and it is my choice not to respond to the other part of what you wrote. If I "chose" not to respond to the other part, according to you, my interpretation is impaired, right? About the red dot system, I don't care for the red dot system, but what I do is, I do not look at the comments, why, because I don't care what others on the anonymous forum have to say in my reputation. So I simply don't care. But if I would care my reputation score on the anonymous forum where no one knows me or for that matter you, then I would check how my reputation is doing every day, just my credit score. Did you think of the possibility that maybe folks at IV want to keep the red dots system the way it is and there is nothing to be fixed? But just because you do not like it, be default you think that something is broken and so it has to be fixed, and, if this is not fixed that means you are not happy, the entire immigration system will continue to be screwed up. Hmmmm, you know, I think some elements of string theory is true that everything is connected in someway, but I am 100% sure that immigration system can be fixed without any change to the red dot system.
And if you think that you or your friends are losing "self-respect" when participating in any internet blogs/forum, and if you find anything offensive on the open internet forum, you are not cut-out for forums and blogs and you cannot help anyone, or, for that matter yourself. If your ego is so shallow that it hurts everytime someone writes anything on the open forum, in this situation, only 1 person needs help, that would be you.

You, .. your self have made a mistake in Interpretating / understanding the post and reacted overly on the second issue by cornering the actual post.
Do you call this as a Interpretation issue?. Did you get what am I saying. First , read and understand what others meant to be. Don't JUMP on it.
If IV cannot fix this RED DOT issue, how could some one believe in IV would fight for FIXING broken immigration system?.

Yes, your point is entirely valid. I didn't know about this cross-country provision. Another unfair provision.
In fact, my point was that unfairness should be dealt with on all possible fronts. If the system works properly, nobody will need to do anything that is even remotely unfair.
I have a strong gut feeling that 2009 would be a good year for EB3. They will start approving more cases I think.
I certainly hope for the best this year. My PD is currently current, but I am still helpless. Can't file a service request nor know any kind of status (unless on pure luck I run into a good natured IO over phone or infopass). Just have to pray that they find and get to my application while dates are still current.
This thing is a dual headed monster....If you conquer the PD head, the processing date Head pops up and vice versa.... I was in same situation briefly ( a month or two of PD being current but Processing dates stuck at July 2, 2007 at NSC) early this year and had to sit back and painfully watch the PD for EB3-I becoming 'U' again. I am more afraid of the 'unavailability' than retrogression now!! With retrogression you can atleast hope it might become current in the next month or one after that. But with 'U' , you just have to wait until Oct next year !!!

By working for the employer for some duration, it is easier to demonstrate that person has intent to work for the employer for the full time job offered. This duration is not written in stone, and every lawyer interprets differently. For me (and this for just me), 90 days should be a safe duration, since it has been tested in courts that 90 days a long enough time when intent of the person can change. (This is known as 30-60-90 day intent rule). This is why lawyers usually advise to wait for 90 days when a person on single intent non-immigrant visa (such as B1 or F1) wants to file for I-130/I-140 and/or I-485.

If I were you, I would talk about my problem and how frustrated I am to ALL my colleagues and friends and well-wishers and get atleast 100 letters that will help to pass the "filing before PD current" admin fix which is part of the current campaign.

Every one has his own vantage point. Mark K has his own and the others who represented for legal immigration has their own. Mark K's argument to only allow the so called 'Einstein caliber" people speaks volumes about how he has simplified the problem.
Sitting on a high position in an immigration research facility does not necessarily mean that he is abreast with the technological needs. From his arguments, he certainly has proven that he has very little or no idea of where the resource needs are.
Everyone of us are here because there is room for us to work. If his research shows that there are more US people who will fill our shoes, then I am sure the market needs would govern the numbers. For all the anti's who cite articles about how low paid we are, how less qualified we are, they should research to complete the full circle. They leave it half-hearted, its not as if they don't know, they just want to stick on to the rhetoric.
Even to entertain Mark K's idea about bringing the so called cream of the crop, there has to be proven ways to identify who these people are. One way of doing it is to allow people to come here on F1, prove their worth in research, work for a few years. One does not become an EB1 qualified before he steps into the country, he probably climbs his way up to that qualification. Some may succeed, some may fail. To selectively choose the best and expel the rest would mean disaster for the country. These are human lives we are talking about, not parts in a process control factory where you can chuck as and when you need as it does not meet 'specifications'.

The most amusing part personally for me is that most of the anti-legal folks accuse the entire industry of conspiring to screw their own. I can see how one or two companies to do that, but to underline that the entire system is geared towards raping their own is blasphemous to say the least.
