Guys,
My wife was working on H1B now and she got EAD last week. Out of the following options which is TRUE and which is BETTER.
Option 1--> Moving to EAD from H1B by signing on I-9
Option 2--> COS from H1 to H4 and then to EAD.
I read in some of our threads that if we choose option 1 and if something goes wrong in AOS, we have to file for new H1B again. We have to wait for quota etc etc.
I also read that if we choose Option 2, if something goes wrong in EAD, we can always change back [ie RESUME]to H1B.
I am not so sure about these. Could some one share their thought.

You can re-file a denied I-140. In my case, first I-140 was denied in 2006 but never received the denial notice, so time for appeal lapsed. However, during 2007 July, we concurrently filed using the same labor. The second I-140 was approved in 2009. Both the I-140s were processed by Nebraska Service Center.
Hence, based on my experience, you can refile but you should be able to over come or at least have strong enough reasons to over come the cause of initial denial.
I am not sure on how to deal with with-drawl of your existing appeal and 485 petitions.
As far as 180 day rule of labor is concerned, my understanding is that, based on USCIS clarification, it only applies to initial filing of I-140 petition but not for re-filing as long as the original I-140 was filed with in permitted time. You can go through websites of Murthy / Rajiv Khanna for authentic information on this.

In CIR 2007 (S.1348) Title V, subtitle B is skill act of 2007 SEC.524 says about people with masters and higher degrees will not be counted against the numerical caps. This says it is amending Section 201(b)(1) (8 U.S.C. 1151(b)(1)) which is about the numerical caps. As this is in the section of backlog reduction does this mean that those who already are in the process and is backlogged will be given green cards out the numerical cap?

I recently found a new job and they filed for my H1 transfer in premium processing. I am still working for my old employer. Now I have got an RFE questioning why my salary (in 2009 W2) which is less than what was mentioned in my previous petition. Even though I have all my paystubs I was on bench for few months between march - may 2009. I have a leave letter for 4 weeks vacation in may and my salary was reduced when I got new project. Which explains why it is less but may not be enough to prove it to USCIS. Salary in W2 could also be less that prevailing wage. Right now I have following scenarios
1. WIthdraw application - not sure repurcussion of this.
2. Respond to RFE with mentioned reason which can have following outcomes
a) Appoved - (good i will be more than happy)
b) Approved with consular processing - (I dont want to travel at this point of time outside US)
c) denied - (not sure)
3. This case goes to DOL and there may be investigation or indent of revoke sent to my employer. Can this happen?
Here are my questions
1. Senario 2.b. If I get "Approved with consular processing" do I have to travel to India for stamping immediately or just get new I94? What will be my current status then? What if I decide not to join the new employer?
2. Senario 2.c. If I get "Denied" what will be my current status?
3. What should I do so that I am not out of status and I dont have to travel to India for stamping?
4. Scenario 3, Can this happen?
Any response will be appreciated. Thanks!

Unfortunately, I don't think it is possible to customize the scrollbar inside a WebBrowser. The WebBrowser is almost a direct inline view of the IE browser, so if your IE browser's scrollbars were different, then I believe the WebBrowser control's scrollbars would be different as well.
In other words, the style is inherited from IE.

Hello I recently purchased a Nikon D70 to use for concert photography. I was using a Sony Mavica CD-250 but it wasn't cutting it for the larger shows where no flash could be used. I just did my first show where flash could not be used and the pictures came out so-so. I have 2 lenses a Nikkor AF 28-80mm and a Nikkor AF 70-300mm. I have full access to photo pits in front of the stage and am wondering what the best settings are for the D70 in these conditions to ensure at least some of the photos will come out decent.
